Any party may change its address or authorized representative by written <br /> notice delivered to the other parties pursuant to this section. <br /> 10.4: Independent Contractor. <br /> For the purposes of the Agreement, each of the parties shall be deemed to be independent <br /> contractors and not employees of any of the other parties. Any and all agents, servants, or <br /> employees of a party or other persons, while engaged in the performance of any work or <br /> services required to be performed by a party under the Agreement, shall not be considered <br /> employees of any other party for any purpose. <br /> 10.5 Damages. <br /> In the event of a party's failure to perform obligations under this Agreement, that party shall be <br /> liable to the other parties for any and all damages reasonably sustained by the other parties as <br /> a result of such failure. <br /> 10.6 Remedies Cumulative. <br /> D -6 <br /> 24 <br />
