City of Centerville <br />Council Meeting Minutes <br />July 23, 2014 <br />Mayor Wilharber opened the Public Hearing at 6:42 p.m. <br /> <br />IV. PUBLIC HEARING <br /> <br />1. Mr. & Mrs. Stan Hasiak, 6994 Centerville Road – Appeal the Designation of Dog as <br /> Potentially Dangerous <br /> <br />Centennial Lakes Police Chief James Coan appeared before Council and stated that on June 17, <br />2014 Community Service Officer Fredrickson was called to receive a dog bite complaint from a <br />gentleman that had been chased by two (2) German Shepard dogs belonging to the Hasiak’s and <br />bit by one (1) and his clothing being nipped at by the other. Chief Coan stated that this evening <br />is to determine whether or not to determine if the dog that bit (Szaryk) be deemed Potentially <br />Dangerous. <br /> <br />Ms. Stephanie Hasiak appeared before Council to appeal the designation of Szaryk as being <br />Potentially Dangerous. Ms. Hasiak stated that all requirements for a dog of this designation have <br />been met including a newly installed fence. CSO Fredrickson stated that at the time of this <br />incident, the Hasiak’s had not been following proper enclosure requirements for the already <br />deemed Potentially Dangerous dog Heidi. CSO Fredrickson stated that snowfencing had been <br />installed in one area rather than the same material that is utilized throughout the remainder of the <br />yard and that has recently been replaced with a more permanent fencing material with a gate. <br />Ms. Hasiak stated that it was not the intent to let the animals out, they just got out during a period <br />that her husband was getting ready to leave. <br /> <br />Attorney Glaser reviewed the requirements for a dog that is deemed Potentially Dangerous by <br />stating that the owners must provide proper enclosure, the dog must be muzzled when outside of <br />that enclosure and on a leash not exceeding six (6) feet, be micro chipped and be annually <br />registered with the City. <br /> <br />Council had confusion regarding which dog had bit during this incident and the deeming of <br />Potentially Dangerous of the other dog. Administrator Larson stated that there were two recent <br />incidents where dogs had bitten but they were two (2) separate incidents with two (2) separate <br />dogs and owners. Administrator Larson stated that Hasiak’s other German Shepard name Heidi <br />had been deemed Potentially Dangerous in 2009 following a bite incident. <br /> <br />Lengthy discussion ensued regarding the Hasiak’s routine with the dogs, leaving their home and <br />gated area, transferring them from the basement to outdoors, rehoming of Heidi, $300,000 <br />liability insurance requirement, deeming of Dangerous versus Potentially Dangerous. <br /> <br />Council Member Paar questioned whether either of these two dogs had been involved with an <br />additional incident several weeks prior. Chief Coan stated that he was unaware of additional <br />incidents but would research the item. <br /> <br />Mayor Wilharber closed the Public Hearing at 7:08 p.m. <br /> <br /> <br />Page 2 of 7 <br /> <br /> <br />
