CITY OF CENTERVILLE <br /> STORMWATER ENFORCEMENT RESPONSE PLAN <br /> Introduction <br /> The intent of this document is to provide guidance to City officials in enforcing the City Code relating to <br /> stormwater management(Stormwater Management Regulations). It should be used only as a guide <br /> while recognizing that each situation is unique.The provisions of this enforcement response plan are not <br /> intended to limit the judgment and flexibility of the Public Works Director in determining an appropriate <br /> response. <br /> While the purpose is to provide guidance for administration of the Stormwater Management <br /> Regulations, including illicit discharges, actual enforcement procedures should consider any unusual <br /> aspects of a violation or condition, as well as special characteristics of an enforcement action,in <br /> determining the proper response. <br /> Minor infractions may be resolved by a verbal notice,telephone call,or warning notice/letter advising <br /> the owner/operator/person of the nature of the violation.If such action fails to generate an adequate <br /> response by the owner/operator/person, further enforcement actions as provided by the City Code may <br /> be taken. <br /> Procedures for Development Site Plan Reviews <br /> This review includes staff level review by the Public Works Director or his designate and may include <br /> the consulting engineer. The Public Works Director maintains a tracking log of all plans reviews for <br /> completeness. <br /> Upon approval of a site development plan by the Planning Commission,the applicant is required to <br /> submit a grading application to the Public Works Department prior to construction. <br /> 1) The grading application must be accompanied by two(2) sets of construction plans,a written <br /> Stormwater Pollution Prevention Plan("SWPPP"),detention calculations,and if applicable,the <br /> Development Agreement approved by the City. <br /> 2) These plans and calculations are reviewed and stamped as approved by the public Works <br /> Director and if required,the consulting engineer. <br /> 3) Upon approval of permits,a grading preconstruction meeting is held with the developer and <br /> contractor to review all site procedures and inspection regimes,before any Best Management <br /> Practice("BMP")is installed or any grading is done.All sites are inspected to verify that the <br /> initial sediment controls are properly installed. <br /> 4) The Public Works Department inspector will visit all active construction sites at a minimum on <br /> a monthly basis. The inspection includes a written report or checklist and shall record any <br /> deficiencies or changes to the SWPPP. If any enforcement actions are required,they will follow <br /> the procedures outlined below.If the City has deferred to RCWD for stormwater permitting and <br /> inspection,then the Director shall monitor inspection reports from RCWD inspector to verify <br /> compliance with the project SWPPP. <br /> 5) Prior to issuance of a Certificate of Occupancy,all permanent stormwater BMP's are inspected <br /> by the City stormwater inspector to ensure they are installed as designed. <br /> C:\Users\tbender\AppData\Local\Microsoft\Windows\Temporary Internet <br /> Files\Content.Outlook\9NJG4319\Enforcement Response Plan 2014-09-29.doc <br /> 70 <br />
