Outlot A,Center Villa <br /> 233122410052 <br /> CITY OF CENTERVILLE,ANOKA COUNTY,MINN. <br /> Findings and Decision <br /> The Planning & Zoning Commission met on November 3, 2014, to hold a public hearing <br /> to consider a request of Will Lessard and Lake Area Contracting to plat their property. <br /> FINDINGS: <br /> 1) The property is currently described as Outlot A within an earlier plat of Center Villa <br /> and is zoned B-1 Commercial. <br /> 2) The Commission finds that there would be benefit to both the City and the applicant <br /> property owners by platting the property. <br /> 3) The applicant provided evidence to show that the two new lots created by the plat will <br /> meet the minimum lot size and dimensions of the zoning ordinance. <br /> 4) The applicant provided evidence that the buildings that are on the property will have <br /> at least the minimum setbacks from the newly created property lines. <br /> 5) State Law allows Anoka County the opportunity to require right of way dedication by <br /> virtue of the fact that the property abuts Anoka County Road CSAR 54. <br /> RECOMMENDATION: <br /> The Planning & Zoning Commission by its action on November 3, 2014, recommends <br /> that the council grant preliminary and final plat approval, subject to the following: <br /> 1) Owner will include any right of way requirements of Anoka County Highway <br /> Department. <br /> 2) The easement for the trail shall be modified to include as-built conditions of <br /> the trail/bike path. <br /> 3) Park land dedication fees shall be paid on Lot 1 prior to recording the plat, in <br /> the amount of$3806 ($2175x1.75 acre). <br /> 4) The park land dedication shall be deferred on Outlot A until further <br /> subdivided or development takes place, but shall be paid at the rate then in <br /> effect. <br /> CITY COUNCIL DECISION: <br /> 1) Findings and recommendation of Planning and Zoning are hereby adopted. <br /> Findings and recommendation are adopted by the Council this 12a' day of November, <br /> 2014. <br /> Tom Wilharber,Mayor <br /> Attest: <br /> Teresa Bender, City Clerk <br /> 72 <br />
