DRAFT 12/2/14 <br /> Slope is the incline of a ground surface expressed as a ratio of horizontal distance to vertical <br /> distance. <br /> Special Water means a surface water or receiving water that is of a high quality or is deemed <br /> worthy to receive extra protection. <br /> Stormwater. Under Minnesota Rule 7077.0105, Subpart 41b), storm water, "means precipitation <br /> runoff, stormwater runoff, snow melt runoff and any other surface runoff and drainage". <br /> According to the Code of Federal Regulations (CFR), under 40 CFR 122.26 [b][13], <br /> "Stormwater means storm water runoff, snow melt runoff and surface and drainage". Stormwater <br /> does not include construction site dewatering. <br /> Storm sewer system, includes but is not limited to, the combination of roadway gutters, roadway <br /> section ditches, culverts, storm sewer piping, overflow channels, infiltration trenches, detention <br /> and retention water quality treatment basins and other methods or devices used for capturing, <br /> conveying, controlling and treating stormwater and snow melt runoff. <br /> Stormwater Pollution Prevention Plan is joint stormwater, erosion prevention and sediment <br /> control plan that is a document containing the requirements of Section I. When implemented,the <br /> plan will define the methods to be used to reduce soil erosion on a parcel of land and off-site <br /> non-point pollution. The plan involves both temporary and permanent controls. <br /> Stormwater pond(also referred to as wet sedimentation basin, wet retention basin, or simply wet <br /> pond) is a man-made or modified natural basin constructed to capture and retain stormwater <br /> runoff for the purpose of removing pollutants and mitigating downstream water quantity impacts. <br /> Surface Waters means all streams, ponds, lakes, marshes, wetlands, reservoirs, springs, rivers, <br /> drainage systems, waterways, watercourses, and irrigation systems, whether natural or artificial, <br /> public or private. <br /> Vegetated (Grassy) swale is a vegetated earthen channel that conveys storm water while treating <br /> the stormwater by biofiltration. Such swales aid in the removal of pollutants by both filtration <br /> and infiltration. <br /> Waters of the State as defined in Minnesota Statutes Section 115.01, Subdivision <br /> 22, the term, " . . . waters of the state means all streams, lakes, ponds, marshes, watercourses, <br /> waterways, wells, springs, reservoirs, aquifers, irrigation systems, drainage systems and all other <br /> bodies or accumulations of water, surface or underground, natural or artificial, public or private, <br /> which are contained within, flow through, or border upon the state or any portion thereof'. <br /> Commentary: According to Minnesota Rules 7050.0130, Subpart A, disposal systems or <br /> treatment works operated under either a Minnesota Pollution Control Agency(MPGA)permit or <br /> an agency certificate of compliance are not considered "waters of the state. " Under Minnesota <br /> Rules 7050.0130, Subpart F, constructed wetlands designed for wastewater treatment are not <br /> "waters of the state."Also see the definition of"Wetlands". <br /> Watercourse is a ditch, stream, creek, or other defined channel intended for the conveyance of <br /> water, runoff, groundwater discharge or similar hydraulic or hydrologic purpose. <br /> Wetlands. "Wetlands" means lands transitional between terrestrial and aquatic systems where the <br /> water table is usually at or near the surface or the land is covered by shallow water. For purposes <br /> of this definition,wetlands must have the following three attributes: <br /> (A) have a predominance of hydric soils; <br /> (B) are inundated or saturated by surface or ground water at a frequency and duration <br /> sufficient to support a prevalence of hydrophytic vegetation typically adapted for <br /> life in saturated soil conditions; and <br /> 28 <br />
