DRAFT 12/2/14 <br /> (D) Permanent boundary markers, in the form of signage approved by the City, should <br /> be installed prior to final approval of the required clearing and grading plan. <br /> 157.11. Maintenance of Stormwater BMP's <br /> (A) The design and planning of all stormwater management facilities shall include <br /> detailed maintenance and repair procedures to ensure their continued function. <br /> These plans will identify the parts or components of a stormwater management <br /> facility that need to be maintained and the equipment and skills or training <br /> necessary. Provisions for the periodic review and evaluation of the effectiveness <br /> of the maintenance program and the need for revisions or additional maintenance <br /> procedures shall be included in the plan. <br /> (B) All private stormwater BMPs shall be maintained by the owner(s) such that the <br /> BMP performs the intended treatment function. Public stormwater BMPs shall be <br /> the responsibility of the City in that the City will ensure that the capacity of <br /> retention/detention ponds is adequate and will repair or replace storm sewer <br /> system components as needed. <br /> (C) The applicant must ensure access to all stormwater treatment practices at the site <br /> for the purpose of inspection and repair by securing all the maintenance <br /> easements needed on a permanent basis. These easements will be recorded with <br /> the plan and will remain in effect even with transfer of title to the property. <br /> (D) The applicant must execute an easement and an inspection and maintenance <br /> agreement binding on all subsequent owners of land served by any on-site <br /> stormwater management measure in accordance with the specifications of this <br /> ordinance. <br /> 157.12-157.14 Reserved <br /> 157.15. Alterations to and Use of Public and Private Stormwater Ponds <br /> (A) No alterations to shorelines or vegetation around stormwater ponds shall be <br /> allowed unless authorized by the City. <br /> (B) Fountains or other circulating devices will not be allowed in stormwater ponds <br /> unless authorized by the City. <br /> (C) Chemical treatment of stormwater ponds will not be allowed unless authorized by <br /> the City. <br /> (D) Structures will not be allowed within the stormwater pond or protective buffer <br /> zone. These will include but not be limited to retaining walls, docks,piers, diving <br /> platforms, etc. <br /> (E) Recreational activities, including but not limited to boating, swimming, fishing <br /> and skating are prohibited on stormwater ponds located on city owned property. <br /> These activities are discouraged on all other ponds. <br /> (F) Dumping of yard waste materials in, on or around any stormwater pond is <br /> prohibited. <br /> (G) Cattails growing in and around stormwater ponds may be cut with the permission <br /> and direction of the City. <br /> 33 <br />
