<br />Planning & Zoning Commission Report and Recommendation. <br /> <br />The Planning & Zoning Commission met on February 7, 2006, to hold a public hearing to <br />consider a request of St. Genevieve Church for a variance to allow an access roadway to <br />be setback from the side property line a distance of nine feet, three inches, rather than 20 <br />feet as normally required. <br /> <br />The applicant requested that the matter be tabled to March 14, 2006, to allow them to <br />provide an alternative plan for consideration. The applicant on March 14, 2006, <br />requested that the matter again be tabled, this time to April 4, 2006, to allow the applicant <br />to meet with the adjoining property owner to try to resolve their concerns about impacts <br />of the reduced setback. The Commission met on April 4, 2006, and adopted these <br />findings and decision. <br /> <br />Findings: <br /> <br />1) The applicant provided evidence that the variance would be needed to avoid a <br />hardship and practical difficulty. <br /> <br />2) The applicant provided evidence that public safety would be compromised if the <br />variance were not granted, specifically that the access roadway would provide the <br />safest design if constructed to align with the adjoining city street (GoitTon Road). <br /> <br />3) The Commission identified adverse impacts to the adjoining property owner that can <br />be mitigated by construction of a screen fence. <br /> <br />FINDINGS AND RECOMMENDATION:. <br /> <br />The Planning & Zoning Commission recommends that the variances be granted, finding <br />specifically that the applicant has satisfied the necessary criteria to qualify; however, <br />subject to conditions that will mitigate the impact on an adjoining property owner. <br /> <br />As a condition of the variance, the Church of St. Genevieve shall construct a six.foot <br />high, alternating board, cedar fence on the adjoining property line with Mr. & Mrs. <br />Joseph Highland, 1680 Heritage Street. The fence shall be constructed beginning three <br />feet west of the adjoining property line of the Highland's and at the setback line of the <br />Highland's home and continue southerly to a point two feet south of the south line of the <br />Highland's property, such fence to be constructed at a right angle to Heritage Street. The <br />fence shall continue easterly on a line two feet south of the Highland's south property <br />line to a point due south of the Highland's east property line. Such fence shall be <br />completed before opening the access road to traffic, and shall be thereafter maintained in <br />good condition and appearance by the Church of St. Genevieve. <br /> <br />Dallas Larson, Administrator <br /> <br />/5 <br />
