TO: Parks & Recreation Committee <br /> FROM: Staff <br /> SUBJECT: $15,000 Allocation from General Fund & Park Dedication Fees <br /> DATE: February 27, 2015 <br /> Some of you may or may not have attending the Joint Work Session with Council and the Planning & Zoning <br /> Commission this Wednesday evening so I just wanted to give you a heads up on what has happened. <br /> Included with your packet are Council's 2015 City Focus Goals and 2015 Ongoing Priorities. Please review <br /> them and if you have questions, please forward them to Mike Ericson, City Administrator at: <br /> mericsongcentervillemn.com. At this same meeting Council was provided with the Parks & Recreation <br /> Committee's Park Improvements—5 year plan. <br /> As you are aware, Council felt that park dedication fees should not be paid by the City on the subdivision/lot <br /> split of City owned property for 140' x 140' of property for water tower maintenance purposes located at 7087 <br /> —20th Avenue South ($4,100). However, a subdivision/lot split for 6995 —20th Avenue South was reaffirmed at <br /> Council's meeting on Wednesday with a promissory note being provided by the property owners to pay park <br /> dedication fees in the amount of$3,806 from the proceeds of the sale. The property owners have six (6)months <br /> to make payment and if they fail to do so $3,806 plus interest will be assessed to their property taxes. The <br /> Committee will receive $3,806 when the promissory note is satisfied or when it is placed on the taxes for 2016. <br /> The owners of the property did not have the funding up front to pay the fees and requested an avenue to pay the <br /> fees from the proceeds of a sale anticipated shortly following recording of the plat with the County and <br /> Mechanical Air Systems, Inc.'s ability to secure a Conditional Use Permit from Council. <br /> The Committee requested that the portion of the City's Code that contained language regarding park dedication <br /> fees and the fee schedule be provided to them. On February 20, 2015 via email both of these items were <br /> provided to Committee Members and Council Liaison King. This section will be receiving additional review by <br /> Council to provide clarification as to what time the City receives park dedication fees (in the past they have <br /> been received from the developer) for a new subdivision not with a building permit as per the Code refers. A <br /> building permit would be fine for a vacant lot/undeveloped lot not covered by a subdivision/platting or <br /> previously paying these fees. The Code needs to address commercial/industrial subdivisions/platting as it <br /> currently does not and the fee schedule does. These two documents need to be in alignment. <br /> Council addressed the Parks & Recreation Committee's $15,000 allotment, park dedication fees, fee schedule <br /> and alignment with City Code, and hockey rink fencing concerns within their 2015 City Focus Goals. <br />
