CITY OF CENTERVILLE, ANOKA COUNTY,MINN. <br /> Findings and Decision <br /> The Planning & Zoning Commission met on March 3, 2015, to consider taking action to <br /> authorize the residential use of Lots 2, 9, 10, 11, Block 3, Centerville. (The "subject <br /> property".) <br /> FINDINGS: <br /> 1) The Commission considered a purchase agreement proposed by Ms. Darlene Farley <br /> to purchase the subject property whereby she would use the existing building and real <br /> property for a single-family,residential purpose. <br /> 2) The Commission found that the subject property is currently zoned M-1, Mixed Use <br /> District, which does not allow residential use except as part of a planned unit <br /> development. <br /> 3) The Commission found that Ms. Farley intended to use the existing building and real <br /> property as a residence, and was not proposing a planned unit development. <br /> 4) The Commission found that the subject property was previously used as a residence <br /> but has since been used as a commercial business, and thereafter has otherwise been <br /> vacant in excess of two years. <br /> 5) The Commission found that previous residential use of the subject property was not <br /> allowed as a non-conforming, preexisting use because the property was now subject <br /> only to the conditions of the existing M-1, Mixed Used District. <br /> 6) The Commission considered the possible ramifications associated with spot-zoning if <br /> the subject property was rezoned to allow unrestricted residential use. <br /> 7) The Commission considered the possible ramifications associated with rezoning if the <br /> entire block (Lots 2-11, Block 3, Centerville) surrounding the subject property was <br /> rezoned to allow unrestricted residential use. <br /> 8) The Commission found that either of the proposed zoning changes would be <br /> inconsistent with the best practices for land use and zoning; would be inconsistent <br /> with the City's "Comprehensive Plan;" and would be inconsistent with the City's <br /> "Master Plan and Development Guidelines for Downtown Centerville." <br /> RECOMMENDATION <br /> The Planning and Zoning Commission, (A) recommends no changes to the existing M-1 <br /> zoning district surrounding Lots 2, 9, 10 & 11, Block 3; and thereby (B) graciously <br /> thanks Ms. Farley for her interested in purchasing the subject property but recommends <br /> that the City not accept the purchase agreement proposed by Ms. Farley. <br />
