SPECIAL ASSESSMENT AGREEMENT <br /> WAIVER OF HEARING AND APPEAL <br /> AGREEMENT made this 5th day of May,2015,by and between the City of Centerville, <br /> a Minnesota municipal corporation("City"), and Chintan K. and Christine M. Patel, ("Property <br /> Owner"),(husband&wife). <br /> RECITALS <br /> A. Property Owner is the fee owner of the following described real property,located <br /> in the City of Centerville,Anoka County,Minnesota("Subject Property"): <br /> PIN#23-31-22-11-0035 Lot 2,Block 3 <br /> 1988 South Robin Lane Royal Meadows <br /> B. Property Owner requests that they connect to the municipal water service line at <br /> the curb stop located within the City's right-of-way which they have not paid an associated <br /> assessment/availability charge.("Public Improvement"). <br /> C. The costs expected to be incurred for the Public Improvement is the amount of the <br /> special assessment listed below. <br /> NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL <br /> COVENANTS,THE PARTIES HERETO AGREE AS FOLLOWS: <br /> 1. The City will assess the Subject Property $6,500. The special assessment <br /> principal shall be payable in equal installments over ten years, plus five percent <br /> (5.00%) interest on the unpaid balance. Interest shall begin accruing on <br /> November 1,2016. The special assessment principal and interest will be certified <br /> to the county and become due and payable on the same schedule as the property <br /> taxes for the Subject Property beginning in 2016. <br /> 2. The Property Owner waives any and all procedural and substantive objections to <br /> the Public Improvement and special assessments, including, but not limited to, <br /> hearing requirements and any claims that the assessment exceeds the benefit to <br /> the Subject Property.
