COUNTY OF ANOKA <br /> CITY OF CENTERVILLE <br /> RES. #15-0 <br /> A RESOLUTION APPROVING FINDING IN FAVOR OF DESIGNATING A DOG AS POTENTIALLY <br /> DANGEROUS <br /> WHEREAS,Ms. Mary Hennessey is the owner of a dog named Ty; and <br /> WHEREAS, on or about May 12, 2015, Ty did leave the premises of the owner and while on the premises of a <br /> neighboring property did bite a youth playing in a group with the dog; and <br /> WHEREAS, the Centennial Lakes Police Department acting as the City Animal Control Officer, subsequent to <br /> investigating the matter, did designate the dog,Ty, as a potentially dangerous animal; and <br /> WHEREAS, dog owner, Hennessey, petitioned the Council to reconsider the designation of her dog, Ty as <br /> potentially dangerous; and <br /> WHEREAS, Council held a hearing on July 8, 2015, and hear testimony by owner Hennessey, in support of <br /> their petition; and <br /> WHEREAS, Council provided an opportunity to the neighboring property owner and victim's parent(s) for <br /> input; and <br /> VHEREAS, Council considered the information provided by Centennial Lakes Police Department, as animal <br /> ontrol officer,that supported the designation of dog, Ty, a potentially dangerous animal. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CENTERVILLE, <br /> MINNESOTA, <br /> 1. The City hereby finds that dog owner Hennessey has not provided evidence to show an error in <br /> the designation of the dog, Ty, as a potentially dangerous animal. <br /> 2. The City finds that the dog did bite a youth while off the dog owner's premises and Council finds <br /> that the dog was not provoked per City Code Chapter 9 1.10 (A), (4) and does not meet the affirmative defenses <br /> in City Code Chapter 91.10, (E). <br /> 3. The decision of the Animal Control Officer designating a potentially dangerous animal is <br /> affirmed. <br /> 4. The owner, Ms. Hennessey or responsible adult in care of, will follow all requirements outlined <br /> in City Code Chapter 91 relating to the keeping of Ty, a potentially dangerous animal. <br /> PASSED AND ADOPTED by the City of Centerville this 22nd day of July, 2015. <br /> Mayor, Tom Wilharber <br /> Attest: <br /> City Clerk, Teresa Bender <br /> 13 <br />
