<br />City of CenterviIle <br />Council Meeting Minutes <br />April 9, 2003 <br /> <br />Ms. Moore-Sykes indicated she is looking into maximum decibel levels and enforcement <br /> <br />information from other ordinances. <br /> <br />Mr. Bisek addressed Council and indicated that he is concerned with the vagueness of the <br />ordinance because it appears that whether or not there is a violation is hearsay from a <br />neighbor. He then said he has purchased a decibel meter to assist him with keeping the <br />sound at a level that does not carry outside the building. <br /> <br />Mr. Bisek indicated this is a situation where there were three people walking around the <br />outside of the building and from the parking lot you could not hear the band. <br /> <br />City Attorney Hoeft indicated the details should not be discussed as a citation was issued <br />and the matter will be discussed in court. <br /> <br />Mr. Bisek indicated he would like to request a permit to continue doing business until the <br />ordinance is rewritten and then said that he would ensure that neighbors a block away <br />would not be hearing the band from their backyards. <br /> <br />Council Member Capra asked, hypothetically, if an officer goes to a resident who is <br />complaining of noise and if the officer can hear the music outside of the bar at the <br />residence loud enough to distinguish the song if it would be considered a violation of the <br />noise ordinance. <br /> <br />Council Member Lee indicated he would like to see the City set a decibel level. <br /> <br />Mayor Sweeney commented that hearing the music a block away means it is too loud. <br />He then indicated he had heard that the music was too loud to converse in Kelly's that <br />evemng. <br /> <br />Mr. Bisek indicated he always fights with the bands over noise because they are all deaf <br />and he has to try to convince them that loud is not always better. He then said that the <br />decibel meter should assist him with keeping the sound down. <br /> <br />There was consent to have a public hearing. <br /> <br />Council Member Broussard Vickers asked whether Council needed to consider a permit <br />for operating after 10:00 p.m. City Attorney Hoeft indicated that there has not been a <br />history of noise violations with this business and said the bands can continue but the <br />noise must be maintained such that it does not disturb the neighbors after 10:00 p.m. until <br />it is determined whether the ordinance will be amended. <br /> <br />Council Member Capra indicated she spoke with the Deputy Chief and was told that no <br />matter what the decibels the sound cannot impede upon another person. City Attorney <br />Hoeft indicated that it is at the officer's discretion as to whether a citation is warranted. <br /> <br />Page 10 of 17 <br />
