broadcaster's/cablecaster's liability and contractual liability coverage, in <br /> protection of the Grantee, the Commission, the City and its officers, elected and <br /> appointed officials, boards, commissions, commissioners, agents, employees and <br /> volunteers for any and all damages and penalties which may arise as a result of <br /> this Franchise. The policy or policies shall name the City and the Commission as <br /> an additional insured, and in their capacity as such, City and Commission officers, <br /> elected and appointed officials, boards, commissions, commissioners, agents, <br /> employees and volunteers. The broadcaster's/cablecaster's liability coverage <br /> specified in this provision shall be subject to Section 9.3 above regarding <br /> indemnification of the City. <br /> 9.4.2 The policies of insurance shall be in the sum of not less than $1,000,000.00 for <br /> personal injury or death of any one Person, and $2,000,000.00 for personal injury <br /> or death of two or more Persons in any one occurrence, $1,000,000.00 for <br /> property damage to any one Person and $2,000,000.00 for property damage <br /> resulting from any one act or occurrence. <br /> 9.4.3 The policy or policies of insurance shall be maintained by Grantee in full force <br /> and effect during the entire term of the Franchise. Each policy of insurance shall <br /> contain a statement on its face that the insurer will not cancel the policy or fail to <br /> renew the policy, whether for nonpayment of premium, or otherwise, and whether <br /> at the request of Grantee or for other reasons, except after sixty(60) days advance <br /> written notice have been provided to the Commission. The Grantee shall not <br /> cancel any required insurance policy without submission of proof that the Grantee <br /> has obtained alternative insurance satisfactory to the City which complies with <br /> this Franchise. <br /> 9.4.4 All insurance policies shall be with sureties qualified to do business in the State of <br /> Minnesota, with an A-1 or better rating of insurance by Best's Key Rating Guide, <br /> Property/Casualty Edition, and in a form approved by the City. <br /> 9.4.5 All insurance policies shall be available for review by the City and the <br /> Commission, and the Grantee shall keep on file with the Commission certificates <br /> of insurance. <br /> 9.4.6 Failure to comply with the insurance requirements of this Section shall constitute <br /> a material violation of this Franchise. <br /> SECTION 10. SALE,ABANDONMENT, TRANSFER AND <br /> REVOCATION OF FRANCHISE <br /> 10.1 City's Right to Revoke. <br /> 10.1.1 In addition to all other rights which City has pursuant to law or equity, City <br /> reserves the right to commence proceedings to revoke, terminate or cancel this <br /> 41 <br />
