11.2.3 Written permission from the Subscriber shall not be required for the conducting of <br /> System wide or individually addressed electronic sweeps for the purpose of <br /> verifying System integrity or monitoring for the purpose of billing. <br /> Confidentiality of such information shall be subject to the provision set forth in <br /> subsection 11.2.2. <br /> SECTION 12. UNAUTHORIZED CONNECTIONS AND MODIFICATIONS <br /> 12.1 Unauthorized Connections or Modifications Prohibited. <br /> It shall be unlawful for any firm, Person, group, company, corporation or governmental <br /> body or agency, without the express consent of the Grantee, to make or possess, or assist <br /> anybody in making or possessing, any unauthorized connection, extension or division, <br /> whether physically, acoustically, inductively, electronically or otherwise, with or to any <br /> segment of the System or to receive services of the System without Grantee's <br /> authorization. <br /> 12.2 Removal or Destruction Prohibited. <br /> It shall be unlawful for any firm, Person, group, company or corporation to willfully <br /> interfere,tamper with, remove, obstruct, or damage, or assist thereof, any part or segment <br /> of the System for any purpose whatsoever, except for any rights the City may have <br /> pursuant to this Franchise or its police powers. <br /> 12.3 Penalty. <br /> Any firm, Person, group, company or corporation found guilty of violating this section <br /> may be fined not less than Twenty Dollars ($20.00) and the costs of the action nor more <br /> than Five Hundred Dollars ($500.00) and the costs of the action for each and every <br /> subsequent offense. Each continuing day of the violation shall be considered a separate <br /> occurrence. <br /> SECTION 13. MISCELLANEOUS PROVISIONS <br /> 13.1 Franchise Renewal. <br /> Any renewal of this Franchise shall be performed in accordance with applicable federal, <br /> State and local laws and regulations. <br /> 13.2 Work Performed by Others. <br /> All applicable obligations of this Franchise shall apply to any subcontractor or others <br /> performing any work or services pursuant to the provisions of this Franchise, however, in <br /> no event shall any such subcontractor or other performing work obtain any rights to <br /> maintain and operate the System or provide Cable Service.
