I did meet with Andrea and <br />Lama last evening regarding the location of a foot bridge on their property. I will be requesting the council <br />srant a 90 day extension on removal of the bridge to this property owner due to the following: <br /> <br />1. Clarification needs to occur on what appears to be a City Trail easement over the utility easement of <br />the property. <br /> <br />. 2. The Zeigler's did not put up the bridge it was put in place by the <br />previous owners of the property due to the neighborhood children being told <br />the trail easement was their for them to use to get to the bus stop located <br />the Mill Road city park property. <br /> <br />3. The Zeigler's are more than happy to remove the bridge or have the City <br />remove the bridge, but have concerns with kids who Iatow of the trail and <br />use the trail of putting logs and other items in the ditch to get across. <br />Thus the bridge was built by the previous owners of the property in an <br />effort to both gain access to their property across the ditch for <br />maintenance and prevent debris from being place in the ditch for foot travel <br />by students using the city trail. <br /> <br />4. Per Dallas in today's plmmittg the City would never put a trail <br />easement over a utility easement Development in this area of the City was <br />in the late 1980's early 1990's, dwing that tUne all residents building <br />here had been told that was a trail easement The easement appears to be <br />20 feet and appears as a trail easement on some of the City maps. <br /> <br />5. The Zeigler's appear to be willing to work with the City to resolve <br />this issue and I feel the City Park and Rec Committee as well as the City <br />attorney needs to provide us with and opinion on this situation. <br /> <br />Mary Capra <br /> <br />1. <br /> <br />.55L <br />
