Section <br />CHAPTER 116: TOBACCO REGULATIONS; SALES <br />116.01 Purpose <br />116.02 Definitions <br />116.03 License required <br />116.04 Fees <br />116.05 Basis for denial of license <br />116.06 Prohibited sales <br />116.07 Vending machines <br />116.08 Self-service sales <br />116.09 Responsibility <br />116.10 Compliance checks and inspections <br />116.11 Other illegal acts <br />116.12 Violations <br />116.13 Exceptions and defenses <br />116.99 Penalty <br />§ 116.01 PURPOSE. <br />The city recognizes that many persons under the age of 18 years purchase or otherwise obtain, possess <br />and use tobacco, tobacco products and tobacco -related devices, and these sales, possession and use are <br />violations of both state and federal laws; and because studies, which the city hereby accepts and adopts, have <br />shown that most smokers begin smoking before they have reached the age of 18 years and that those persons <br />who reach the age of 18 years without having started smoking are significantly less likely to begin smoking; and <br />because smoking has been shown to be the cause of several serious health problems which subsequently place a <br />financial burden on all levels of government; this chapter shall be intended to regulate the sale, possession and <br />use of tobacco, tobacco products and tobacco -related devices for the purpose of enforcing and furthering <br />existing laws; to protect minors agamst the serious effects associated with illegal use of tobacco, tobacco <br />products and tobacco devices; and to further the official public policy of the State of Minnesota in regard to <br />preventing young people from starting to smoke as stated in M.S. § 144.391, as it may be amended from time to <br />time. <br />Ord. 966, adopted - - <br />§ 116,02 DEFINNITIONS. <br />202 1 Page <br />
