<br />notice by City - $50.00 each occurrence. <br /> <br />d. Failure or neglect to provide notice to involved resident when solid waste or <br />recyclables refused for collection for cause - $25.00 each occurrence. <br /> <br />e. Repeated failure or neglect to correct problems will be considered a breach of contract <br />- $50.00 each occurrence. <br /> <br />f. Failure to abide by the City's regular collection hours - $250.00 each occurrence. <br /> <br />g. Missing entire blocks or neighborhoods. A missed block is defined as a block where <br />residents from at least three households within two intersections ofthat block or cul- <br />de-sac report that their material was out before 6:00 a.m., the material was not picked <br />up within 24 hours after either oral or written notice from the City and the addresses <br />did not appear on the records as unacceptable setouts - $250.00 each occurrence. <br /> <br />h. District-wide collection not completed. The failure to complete a majority (50% or <br />more) of pickups within the city or collection district on the scheduled collection day <br />without following proper notification procedure - $2,500.00 per occurrence. <br /> <br />5. Legal Compliance. <br /> <br />a. This Contract is governed by the laws of the State of Minnesota. The Contractor must <br />obtain all licenses or permits to transact a refuse collection business in the City, <br />Anoka County, and the State of Minnesota. <br /> <br />b. The Contractor will comply with all health rules, regulations, and ordinances of the <br />City, Anoka County, and the State of Minnesota. If there is a conflict between the <br />provisions of this contract and the pertinent ordinances, regulations, and statutes the <br />more stringent requirements apply. <br /> <br />c. The Contractor must report all violations of ordinances pertaining to garbage and <br />refuse collection and disposal for enforcement purposes including all unsanitary or <br />filthy conditions to the City. <br /> <br />6. Safety. The Contractor must provide and maintain sanitary and safety accommodations for <br />the use and protection of its employees and comply with federal, state, and local safety <br />codes and regulations. <br /> <br />D. Pavment Method. <br /> <br />1. Collection Service. Waste Management will bill each resident directly for the services <br />provided per Attachment A. Attachment A may be modified jointly by the parties to reflect <br /> <br />-10- <br />
