Stat. ~ 412.641 <br /> <br />City Admininstrator <br /> <br />appointed for an indefinite period of time and need not be a resident <br />of the city in order to hold the position. <br /> <br />2. Removal <br /> <br />The city manager may be removed by the c01U1cil at any time. <br />However, if the manager has served for one year or longer, the <br />manager may demand written charges and a public hearing on the <br />charges before the final removal takes effect The demand for written <br />charges must be made within seven days of notification of the <br />council's intent to remove the manager. <br /> <br />The council must set a date and a reasonable time for a public <br />hearing. The hearing must be held within 30 days of the manager's <br />demand and the hearing may not be recessed or reconvened until a <br />further date unless approved by the council. <br /> <br />Pending the hearing, the council may suspend the manager, with or <br />without pay. The council may designate another qualified person to <br />perform the duties of the manager during absence or disability. <br /> <br />The council must notify the city manager within five days of the <br />hearing of their decision to retain or remove the manager. <br /> <br />City councils that are considering removal of their manager should <br />consult with their city attorney before beginning the removal <br />process. The council should also consider any relevant employment <br />contract language, personnel policies, and ordinance or charter <br />prOVISIOns. <br /> <br />Part VI. Common issues <br /> <br />There are a number of areas that raise questions for city councils <br />regarding city clerks, administrators, and managers.
