A <br />substantial breach by a permittee inelude~, but is not limited <br />to, the following: <br /> <br />(1) a material violation ot . provision of the right-of-way <br />permit; <br /> <br />(2) an evaaion or attempt to evade any material provision <br />of the right-or-way permit, or the pe~petration or attempt to <br />perpetrate any fraud or deceit upon the local government unit or <br />i1:1O: I::itizens; <br /> <br />(3) a material misrepreeentation of fact in ths <br />right-ai-way pe~mit applioation; <br /> <br />(4) ~ tailure to complete work in a timely manner, unle~5 a <br />pe~mit exten5ion is obtained or unless the failure to complete <br />work is due to re~$ons beyond the permitteer~ control; ana <br /> <br />(!) ~ failure to correc~, in a timely m4nne~, work that <br />does not conform to applicable standard~1 conditions, or codes, <br />upon in3pe~tion and notification ~y the local ~overnment unit of <br />the taulty condition. <br /> <br />(d) Subj~ce to this subdiv~sion, a local government unit <br />may not deny an application for a right-or-way permit ~O~ <br />failure to inclu~e a project in e plan aubrnitted to the local <br />government unit under subdivision 2, paragr_ph (~), olause (2), <br />wh~n the teleco~~nications right-oi-way user has used <br />commercially reasonable effort~ to anticipate and plan for the <br />project. <br /> <br />(~) In no event may a local sovernment unit unreaeonably <br />withhold approv~l of an application for a right-of-way permit. <br />or unreasonably revoke a permit. <br /> <br />Subd. 5. App8a~. A telecommunications right-oE-way <br />user that: (l) has been denied registration; (2) has b~en <br />denied a right-ot-way permit; (3) haa had its right~of-way <br />p~rmit revoked; or (4) believes that the fees imposed on the <br />user by cne local governm.ne unit do not conform to the <br />requirements of 5ubaivi6ion 5, may hav~ the denial, revocation, <br />or tee imposition reviewed, upon written request, ~y the <br />governing ~ody of the local government unit. The governing body <br />of the local sovernment unit shall act on a timely written <br />~e~uest at its next regularly schaduled meeting. A decisio~ by <br />the governing body affirming the deni~l, revocation, or fee <br />imposition must be in writing and $upported by written findings <br />establishing the reasonableness of the decision. <br /> <br />Subd. 5. Pees. (a) A local government unit may <br />recover its right.of-way management costs by impo~lng a fee for <br />resi~tration, a fee for each right-ot-way permit, or, when <br />appropri~te, a fee applicable to a particular telecomm~nication5 <br />right-Of-way user when that user ca~ses the 10c.l government <br />unit to incur costs as a result of actions O~ inactions of that <br />user.
