<br />City of Centerville <br />November 13, 2002 <br />Council Meeting Minutes <br /> <br />VOTE: Ayes - 4, Nays -1(Broussard Vickers). Motion carried. <br /> <br />5. Liquor License Renewal - 2003 <br /> <br />Motion by Council Member Broussard Vickers, seconded by Council Member <br />Travis to approve the liquor license renewals for 2003 for Richard A. DeFoe Ent., <br />Inc. dba W~ter Works Beach Club, Mountain Enterprises, Inc. dba, Trio Inn, <br />SaHawk, Inc. dba Sager's Liquor and Wiseguys Pizza, Inc. based on approval by <br />the Police Chief and completion of aU required information. <br /> <br />Mayor Swedberg asked if the licensees were going to follow the best practices. Ms. <br />Moore-Sykes indicated she met with the license holders to discuss the requirements and <br />the liquor license holders felt it would be a good idea to have other business owners be <br />privy to the information shared. <br /> <br />Council Member Nelson asked if Ms. Moore-Sykes had the 40-point selection in her <br />office. Ms. Moore-Sykes indicated she did have it. <br /> <br />VOTE: All in favor. Motion carried unanimously. <br /> <br />6. Tobacco License Renewal- 2003 <br /> <br />Mayor Swedberg indicated the Police Chief is recommending that Tom Thumb's license <br />to sell tobacco products not be renewed. <br /> <br />Motion bv Council Member Broussard Vickers, seconded by Council Member <br />Nelson to fine Kelly's Korner $500 for a second violation of selling tobacco to an <br />underage person. AU in favor. Motion carried unanimously. <br /> <br />Motion by Council Member Broussard Vickers, seconded by Council Member <br />Nelson to fine Tom Thumb $750 for a third violation of selling tobacco to an <br />underage person. AU in favor. Motion carried unanimously. <br /> <br />Motion by Council Member Broussard Vickers, seconded by Council Member <br />Nelson to deny the renewal of Tom Thumb's tobacco license based on the <br />recommendation of the Police Chief due to repeated yiolations of selling tobacco to <br />minors. <br /> <br />City Attorney Hoeft reminded Council that the City would need to notify Tom Thumb <br />that the license would not be renewed as well as a notice that they may appeal the <br />decision. <br /> <br />Council Member Capra expressed concern with the recent decision by the City of <br />Bumsville to revoke the tobacco license of SuperAmerica as it was overturned in the <br /> <br />Page 23 of29 <br />
