MAINTENANCE AGREM111111,S-AT <br />Stormwater Management Facilities <br />T faw")MAIR �4M&41I <br />This Maintenance Agreement ("Agreement") is imade by and behNeen 'the Rice Creek <br />Watershed District, a watershed district with purposes and powers set -forth at Minnesota <br />Statutes Chapters 1031E and 1031D and a drainage authorility pursuant to chapter 103E of <br />the laws of the State of Minnesota, (RCWD), and [NAME AIND DESCRIPTION OF <br />PUBLIC EINTITY WITH WHICH AGREEMENT IIS TO BE MADE;j ("Permittee"). <br />Recitals and Statement of Purpose <br />WHEREAS pursuant to IMinnesota Statutes § 103D.,345,, the RCWD has adopted <br />and implements Rule C, Stormwater Il anagernent Plans; <br />WHEREAS IRule C imposes certain requirements, which the Permittee will meet <br />in this case by constructing and maintaining stormwater management facilities as <br />!identified oin the site plan !incorporated into this Agreement as Exhibit & <br />WHEREAS in accordance with Rule C and as a condition of Permit <br />the Permittee's obligation -to maintain these stormwater facilities must The m;min -oriallized <br />by a recorded maintenance declaration or, alternatively, a maintenance agreement <br />establishing the Permliftee's perpetual maintenance obligation; <br />WHIE( EAS'the Permittee and the RCWD execute this Agreernen'tto'tui ffill the <br />condition of Permit-, and concur that it is binding and rests on mutual valuable <br />consideration; <br />Ile <br />ON THE EXHIBM.
