Agreement between Adjoining Owners Creating Easement for Common Driveway <br />Agreement made on the _ day of March, 2015, between Lake Area Utility <br />Contract of 2303 Tart Lake Road, Lino Lakes, MN 55038, and Timothy McNamara of <br />(street address, city, county, state, zip code). Do we want site address or living address ? <br />Lake Area Utility and Timothy McNamara recite and declare as follows: <br />A. The parties have an interest in adjoining real estate situated in the City of <br />Centerville, County of Anoka, State of Minnesota, and described, respectively, as <br />follows: <br />Lot 1 Block 1 Center Villa, Anoka County, Minnesota to be referred to as Lot 1 and <br />Outlot A, Center Villa, Anoka County, Minnesota to referred to as Outlot A <br />B. The parties desire to create a common driveway between the above- <br />described adjoining lots owned by them for the benefit of each of them. <br />In consideration of the above recitals and the terms and covenants of this <br />agreement, the parties agree as follows: <br />1. Lot 1 will have access over the existing driveway on Outlot A per the <br />attached Exhibit A with access over entire Drive way hatched area as shown on Exhibit A <br />Future purchaser of Out lot A will have the right to move the drive way entrance to the <br />(24' Future Driveway Connection ) as shown on Exhibit A and then the width of the <br />driveway will reduced to the 60' by 223.88 rectangle shown on Exhibit A. The cost of <br />moving and or creating the new entry from 20th Avenue North will be paid for by the <br />owners of Out lot A, at their sole cost and expense <br />Maintenance for the Shared driveway will be born by the owners of Lot 1 until Outlot A <br />is sold and being used by Outlot A. Once Outlot A is using the shared driveway the <br />maintenance shall be shared evenly between Outlot A and Lot 1. <br />2. The easement created by this agreement is superior and paramount to the <br />rights of either of the parties to this agreement in the respective servient estates so <br />created, and the parties further agree that it is a covenant that shall run with the land, <br />unless agreed by both parties to change the easement. <br />WITNESS our signatures as of the day of 920 <br />
