<br />CITY OF CENTERVILLE <br />ANOKA COUNTY, MINNESOTA <br /> <br />ORDINANCE #6, Second Series <br /> <br />AN ORDINANCE AMENDING CITY CODE, CHAPTER 154.016: NON- <br />CONFORMAING USES AND STRUCTURES <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS: <br /> <br />Section 1. Section 154.016 of the Centerville City Code is hereby amended by adding <br />the following paragraph: <br /> <br />E. A structure that consists of a one-family or two-family <br />dwelling that is a lawful non-conforming use located in a <br />Business District or Industrial District may, upon being <br />damaged to an extent exceeding 50 percent of its fair <br />market value, be repaired to its preexisting condition, <br />provided that the non-conformity does not also include <br />inconsistencies with regulations of flood-plains or <br />shoreland protection. If no building permit to repair the <br />dwelling is issued by the City within six months of the date <br />of the event where damage occurs, then the lawful non- <br />conforming use status shall cease and the land shall be used <br />only in conformity with the allowed uses in the District. <br /> <br />Section 2. Effective Date.
