<br />(vi) a change in the place of residence of the Participant, or <br />Participant's spouse or Dependent; <br />(vii) for all benefits under this Plan except health care <br />reimbursement coverage under paragraph 5.2.2, a change in <br />coverage of a Participant's spouse or Dependent made during the <br />open enrollment period of the spouse's or Dependent's employer; <br />or <br />(viii) such other events as may constitute status changes under <br />applicable law and regulations, and that the Employer, in its sole <br />discretion, decides to recognize as Status Changes under the Plan. <br />Additionally, with respect to any accident or health plan, Status Change means: <br />(ix) the exercise of a right under the special enrollment rules of Code <br />Section 9801(f) (HIPAA enrollment rights); <br />(x) the entitlement of a Participant or a Participant's spouse or <br />Dependent who is enrolled in an accident or health plan of the Employer to <br />coverage under Part A or B of Title XVIII of the Social Security Act <br />(Medicare) or Title XIX of the Social Security Act (Medicaid) (other than <br />coverage for pediatric vaccines); or <br />(xi) a change required under a judgment, decree or order resulting from <br />a divorce, legal separation, annulment, or change in legal custody that <br />requires accident or health coverage for the child of a Participant who is a <br />Dependent of the Participant. <br />Section 2.2 Gender and Number. Pronoun references in the Plan shall be deemed to be <br />of any gender relevant to the context, and words used in the singular may also include the plural. <br />Article III. Eligibility and Participation Conditions <br />Section 3.1 Participation Conditions. As a condition to participation and receipt of <br />benefits under this Plan, an Eligible Employee agrees to: <br />(a) Furnish to the Employer the application to participate provided for <br />in Section 3.2 within thirty (30) days of becoming an Eligible Employee; <br /> <br />6 <br />
