<br />Memo.... <br /> <br />TO: Honorable Mayor and Council Members <br /> <br />FROM: Teresa Bender, City Clerk <br /> <br />SUBJECT: Trio Inn - Tobacco Compliance Failure - 2004 <br /> <br />DATE: December 3, 2004 <br /> <br />Records indicate that the Trio Inn has been tobacco compliance failure free for the last <br />five years. <br /> <br />Previous practice has been to impose administrative fines by resolution (per Ordinance <br />#66) for violations of the ordinance. <br /> <br />Research shows that previously the administrative fines that have been imposed for other <br />licensees are as follows: <br /> <br />Second violation in three years - Kelly's ($500.00) <br />Three violations in three years - Tom Thumb ($750.00 & Non-Renewal) <br /> <br />I was unable to locate a resolution for Tom Thumb's first violation in 2000; however, it <br />appears that the administrative fine would be $250.00 for first violations. <br /> <br />Please see the attached letter to Mr. Montain regarding Council's next meeting for <br />consideration of this issue. <br />
