City of Centerville <br /> Council Meeting Minutes <br /> May 9,2018 <br /> Attorney Glaser stated that the city generally accepts letters of credit for landscaping; however, <br /> the Pederson's/Ruffridge-Johnson 1031, LLC desired to pay cash. He explained that the money <br /> would be held in escrow with the city in the event that landscaping was not completed on the site <br /> allowing the city to complete the open items with the escrowed funds. <br /> Discussion ensued that the amount is normally 125% of what is needed to cover the requirements <br /> that must be met, the city's ability not to issue a Certificate of Occupancy if the requirements are <br /> not met and ensuring that the city is not liable for unfinished requirements. <br /> Motion by Council Member Montain, Seconded by Council Member King to Approve the <br /> Site Plan Landscaping Escrow Agreement from Jon R. & Sophie Pederson and Ruffrid2e- <br /> Johnson 1031, LLC as submitted. All in favor. Motion carried. <br /> 5. Jon R. & Sophie Pederson Conditional Use Permit <br /> Attorney Glaser stated that the only modification to the previous Conditional Use Permit (CUP) <br /> is that the names have been changed. He explained that the estate of Jon R. & Sophie Pederson <br /> own the land and the corporation owns the building. He stated that this provides the Pederson's <br /> with estate planning benefits. Attorney Glaser stated that this has benefits for both parties. <br /> Motion by Council Member Montain, seconded by Council Member Koski to Approve the <br /> Conditional Use Permit as presented. All in favor. Motion carried. <br /> IX. NEW BUSINESS <br /> 1. MN Dept. of Health Source Water Protection Implementation Grant <br /> Administrator Statz stated that the City was successful in obtaining a grant from the MN Dept. of <br /> Health for Source Water Protection Implementation. He stated that he desired for Council to <br /> accept the grant and authorize forwarding of the agreement to them. He reported that the grant <br /> funds would be expended to complete items contained within the current plan. <br /> Discussion ensued regarding wells, contamination, the Well Head Protection Area not only <br /> including the City of Centerville but also includes a portion of Hugo, multiple agencies working <br /> together and the necessity of municipal connection. <br /> Motion by Council Member Montain, seconded by Council Member King to Accept and <br /> Authorize Staff Entering into Agreement for Source Water Protection Implementation <br /> Grant from the MN Dept. of Health as submitted. All in favor. Motion carried. <br /> 2. Multi-Function Copier/Printer/Scanner—Public Works <br /> Administrator Statz explained that the current copier housed at the Public Works building is <br /> outdated and has surpassed its useful life. He stated that parts are difficult to obtain and costs are <br /> increasing. He reported that staff had obtained two quotes for replacement with one being from <br /> Page 6 of 8 <br /> 7 <br />
