Permit. Subject to the terms and conditions set forth herein, the City of Centerville <br /> hereby grants approval of a CONDITIONAL USE PERMIT to "Grantee:" <br /> 2. Site. The permit is for the following plat: <br /> BAY VIEW VILLAS,EXCLUDING LOT 10,BLOCK 1 <br /> 3. Conditions. This permit applies to the following property: <br /> a) The Planned Unit Development will be consistent with the Comprehensive Plan <br /> once the Amendment has been approved by the Metropolitan Council. <br /> b) As the development does not meet specific requirements of the shoreland <br /> provisions for setbacks (50-60' from the ordinary high water line) and lot size <br /> (10,000 square feet and 62' wide) and must meet the intent of the ordinance to <br /> preserve the body of water and shoreline. The shoreland will be preserved by <br /> designating a swath of land back from Centerville Lake's ordinary high water line <br /> for common HOA ownership (30-foot) deep; Outlot B. Said disturbed areas of <br /> Outlot will be landscaped per approved plan. Grading shall minimize vegetation <br /> removal protecting the character of the current shoreline and future health of the <br /> lake from runoff Units 1, 2 and 3 in Block 1 are in the 100 year floodplain and <br /> being mitigated through a separation from Centerville Lake's ordinary high water <br /> line within 30-75' of a flood mitigation zone. Units must meet FEMA approval <br /> and vacation of St. Paul Regional Water easements. <br /> c) Access to the new development will be through a newly constructed roadway with <br /> a cul-de-sac ending within the subject development directly from Main <br /> Street/CSAH14 and directly across from Peltier Lake Drive. The roadway will <br /> meet all Centerville requirements and will provide access from LaValle Drive for <br /> five(5)neighboring properties on the east. <br /> d) The Final PUD Development Plan shall include a Landscaping Plan provided by a <br /> licensed Landscape Architect. <br /> e) The Final Plat shall be approved by the City Council <br /> f) The developer(s) shall obtain approval of the LaValle Drive access relocation <br /> plan from Anoka County. <br /> g) The developer shall address all Plan Review comments to the satisfaction of the <br /> Centerville Public Works Department, City Engineer and Public Safety Officials. <br />
