■■rrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr� <br /> CITY OF CENTERVILLE,ANOKA COUNTY,MINN. <br /> Findings and Decision <br /> The Planning & Zoning Commission met on July 10, 2018, to hold a public hearing to <br /> consider a request for a variance to the setback for a driveway at: Lot 6, Block 4, Royal <br /> Meadows, City of Centerville,Anoka County, State of Minnesota. <br /> FINDINGS: <br /> 1) The property is legally described as: Lot 6, Block 4, Royal Meadows, City of <br /> Centerville,Anoka County, State of Minnesota. <br /> 2) The applicant has submitted an application for a variance from the setback for a <br /> driveway. City code requires a 5-foot setback from the property line and a minimum <br /> of a 9-foot wide driveway. <br /> 3) The Commission finds that the unique characteristics of this property make <br /> constructing a driveway within the minimum width and standard setbacks impossible. <br /> 4) The Commission finds that constructing a driveway is a reasonable use of the land, <br /> does not disrupt the essential character of the neighborhood and is in conformance <br /> with the city's Comprehensive Plan. <br /> 5) Circumstances beyond the control of the homeowner which contribute to the need for <br /> a variance include,the proximity of the home to the property line,on both sides of the <br /> lot, the issuance of a building permit for a garage in the rear of the home and the <br /> existence of a partial driveway on the west end of the property's frontage. <br /> 6) The issuance of a variance is also justified by the fact that the necessary <br /> encroachment into the setback is limited to a small area near the front of the home <br /> (the setback is achievable as you approach the rear of the home. Also, the <br /> encroachment is adjacent to park land, so as not to interfere with a neighboring <br /> homeowner's enjoyment of their land. <br /> RECOMMENDATION: <br /> The Planning&Zoning Commission by its action on this July 10, 2018,recommends that <br /> the council grant a variance to the side yard setback for a driveway to the extent <br /> necessary to construct the minimum width driveway along the west side of Lot 6, Block <br /> 4,Royal Meadows,City of Centerville,Anoka County, State of Minnesota <br />
