S,,,ir'ATEIIl EI,1I11T OI,,,,' IPIZOEIAI"Il,,,,,,EC AU,SE On or about April 19, 2017, at approximately 1:21 a.m., Centennial Lakes Police Officers Stepan responded to 7087 20th Ave S, City of Centerville, County of Anoka, in response to multiple noise complaints. 7087 20th Ave. S. is the location of Alex's Lawn and Turf. Upon arriving, Officer Stepan observed a large front end loader loading a dump truck. Officer Stepan noted the two pieces of equipment were causing a large amount of noise while being operated. Officer Stepan advised an employee on the site that the noise at that hour was a violation of the city's noise ordinance. The employee stated they were working on a project, and were only allowed to work on the project at night. Officer Stepan reiterated the noise at that time of night was in violation of the city's noise ordinance and the employee told Officer Stepan to "speak with [the] boss." Thereafter, at approximately 10:30 a.m. Centennial Lakes Police Officer Krueger responded to the location and spoke with the owner, ALEX JAMES SHUDA (DOB: 0511211982), the defendant. Defendant admitted the employees were working on a"night job" and were running dump trucks and tractors for a job involving wood chips and mulch. Officer Krueger advised Defendant of the numerous noise complaints and reminded Defendant that there was to be no activities of any powered machinery prior to 7:00 a.m. Defendant stated this would be "the last time." Alex's Lawn and Turf was issued a Conditional Use Permit on November 11, 2014 by the City of Centerville. The Permit is subjected to the following condition: m) Limits on the noise emitted at the property line shall conform to the noise regulations contained in the City Code Section 91.09 and the use is subjected to other nuisance regulations contained in Chapter 91. Any violation of the terms of the Permit is a criminal misdemeanor.
