S,,,ir'ATEIIl EI,1I11T OI,,,,' IPIZOEIAI"Il,,,,,,EC AU,SE <br /> On or about April 19, 2017, at approximately 1:21 a.m., Centennial Lakes Police Officers Stepan <br /> responded to 7087 20th Ave S, City of Centerville, County of Anoka, in response to multiple noise <br /> complaints. 7087 20th Ave. S. is the location of Alex's Lawn and Turf. Upon arriving, Officer Stepan <br /> observed a large front end loader loading a dump truck. Officer Stepan noted the two pieces of equipment <br /> were causing a large amount of noise while being operated. Officer Stepan advised an employee on the <br /> site that the noise at that hour was a violation of the city's noise ordinance. The employee stated they were <br /> working on a project, and were only allowed to work on the project at night. Officer Stepan reiterated the <br /> noise at that time of night was in violation of the city's noise ordinance and the employee told Officer <br /> Stepan to "speak with [the] boss." <br /> Thereafter, at approximately 10:30 a.m. Centennial Lakes Police Officer Krueger responded to the location <br /> and spoke with the owner, ALEX JAMES SHUDA (DOB: 0511211982), the defendant. Defendant admitted <br /> the employees were working on a"night job" and were running dump trucks and tractors for a job involving <br /> wood chips and mulch. Officer Krueger advised Defendant of the numerous noise complaints and <br /> reminded Defendant that there was to be no activities of any powered machinery prior to 7:00 a.m. <br /> Defendant stated this would be "the last time." <br /> Alex's Lawn and Turf was issued a Conditional Use Permit on November 11, 2014 by the City of <br /> Centerville. The Permit is subjected to the following condition: m) Limits on the noise emitted at the <br /> property line shall conform to the noise regulations contained in the City Code Section 91.09 and the use is <br /> subjected to other nuisance regulations contained in Chapter 91. Any violation of the terms of the <br /> Permit is a criminal misdemeanor. <br />
