WATER CONNECTION ORI NANCE, POLICY AND DISCLOSURE FORM—DRAFT VERSION 08/13/18 <br /> the effective date of this ordinance, the property must abandon the private system and connect to <br /> municipal sewer no later than 12-31-2012. <br /> (D)All property served by private water and sewer systems must connect to public water and public <br /> sewer, if a public services are available to serve the property:1)upon sale or transfer of ownership of <br /> a parcel with a principal structure, or 2)upon expanding the structure square footage by 33%or more, <br /> or 3)upon issuance of a building permit that increases the value of a home by$10,000 or more. <br /> §51.201 TRANSFER OF PROPERTIES. <br /> (A) Whenever a conveyance of land occurs, the following requirements shall be met: <br /> (1)The seller of the property is responsible for providing a completed City of Centerville point of <br /> sale certificate, with any required attachments, to the buyer at or before closing.These <br /> documents shall provide the status and location of all known private water or sewer <br /> connections and components thereof on the property and, if applicable,the requirements for <br /> bringing the dwelling or other structure into compliance with this chapter; <br /> (2)The buyer is responsible to file the City of Centerville point of sale certificate, and required <br /> attachments, along with the certificate of real estate value at the County Auditor's Office; and <br /> (3) If the seller fails to provide a certificate of compliance, sufficient security must be established <br /> in the form of an escrow account to assure the installation of connections to the public water <br /> and sewer.The security, in the amount set forth in the City of Centerville Fee Schedule, shall be <br /> placed in an escrow with the City, a licensed real estate closer, licensed attorney-at-law, or <br /> federal or state chartered financial institution. Connecting to public water and sewer must be <br /> installed within the time frame established in §§52.199.After connecting to public water and <br /> sewer and a certificate of compliance issued, the escrow may be released. [SHOULD WE CREATE <br /> AN OPTION TO RELEASE PAYMENTS TO CONTRACTORS?] <br /> (B)The compliance with this chapter is not required if the sale or transfer involves one of the <br /> following circumstances: <br /> (1) Dwellings or other structures connected to a municipal water supply system and municipal <br /> wastewater sewer; <br /> (2) Dwellings or other structures where a connection to a municipal water supply system or <br /> municipal wastewater sewer is not available; <br /> (3)Tract of land is vacant or contains no structures with plumbing fixtures; <br /> (4)The existing dwelling or other structure with plumbing has been abandoned per§52.058. <br /> (Compliance by filing a certificate of plumbing abandonment with the City.); <br /> (5)The transfer does not require the filing of a certificate of real estate value, as described in <br /> M.S. § 272.115;1 <br /> 1 These are generally non-monetary transfers. For example,transferring property from personal ownership into a <br /> trust,or gifting your property to certain family members. <br />
