In the event of a violation or a threat of a violation of this chapter, the city <br /> may institute appropriate civil actions or proceedings, including injunctive relief,to prevent, restrain, <br /> correct, or abate such violations or threat of violations.The city may recover costs incurred for <br /> corrective action in a civil action in any court of competent jurisdiction, and such costs may be certified <br /> by court order to the County Auditor as a special tax against the real property.These and other <br /> remedies, as determined appropriate by the city, may be imposed upon the property owner, permittee, <br /> licensed installer, or other responsible person, either in addition to or separate from other enforcement <br /> actions. <br /> §51.213 INTERPRETATION. In their interpretation and application, the provisions of this chapter shall be <br /> held to be minimum requirements and shall be liberally construed in favor of the city, and shall not be <br /> deemed a limitation or repeal of any other powers granted by Minnesota Statutes. <br /> §51.214 FAILURE TO COMPLY- RESPONSIBLE PARTY. <br /> Should the seller fail to disclose the conditions required by this chapter to the buyer, and neither party <br /> established an escrow account, the buyer of the property becomes wholly responsible and shall certify <br /> compliance to the City as to the conditions required by this chapter within 30 days of the property <br /> transfer or have the dwelling or other structure brought into compliance within 90 days of the property <br /> transfer. In the event of failure to comply, the seller remains criminally liable for failing to comply with <br /> the requirements of this chapter. <br /> §51.999 PENALTY. Any person, firm, agent, or corporation who violates any of the provisions of this <br /> chapter, or who fails, neglects, or refuses to comply with the provisions of this chapter, including <br /> violations of conditions and safeguards, or who knowingly makes any material false statement, or <br /> knowing omission in any document required to be submitted under the provisions hereof, shall be guilty <br /> of a misdemeanor and upon conviction thereof, shall be punishable as defined by Minnesota State <br /> Statutes.
