CITY OF CENTERVILLE <br /> COUNTY OF ANOKA <br /> STATE OF MINNESOTA <br /> ORDINANCE 418-xx <br /> AN ORDINANCE OF THE CITY COUNCIL OF CENTERVILLE, MINNESOTA, <br /> APPROVING A PLANNED UNIT DEVEOPMENT AND CONDTIONAL USE PERMIT <br /> FOR THE BAY VIEW VILLAS <br /> WHEREAS, RICHARD A. DEFOE AND KARNA J. DEFOE, ("Applicant"), are the fee owners <br /> of these "Subject Parcels" as legally described in Exhibit A, attached. <br /> WHEREAS, Applicant obtained preliminary approval for the Plat, BAY VIEW VILLAS. Said <br /> Plat combines the Subject Parcels into a unified parcel for subdivision into blocks, lots, and <br /> outlots. <br /> WHEREAS, the Planning and Zoning Commission held a series of land use hearings ultimately <br /> resulting in combining and replatting the Subject Parcels into the Plat, BAY VIEW VILLAS. All <br /> of these applications were brought in conjunction with an application for a Planned Unit <br /> Development. <br /> WHEREAS, the Applicant obtained the RECOMMENDATION of the Planning and Zoning <br /> Commission to GRANT variances pursuant to a Planned Unit Development and set forth <br /> conditions in the form of a Conditional Use Permit governing the development of the parcel and <br /> the construction of improvements thereon. <br /> WHEREAS, at its meeting on June 5, 2018, the Planning and Zoning Commission made the <br /> FINDINGS with respect to the application for a Planned Unit Development and Conditional Use <br /> Permit by its adoption of the Memorandum, dated July 10, 2018, from Phil Carlson and Beth <br /> Elliot, from Stantec, regarding the Bay View Villas — Comprehensive Plan Amendment, <br /> Rezoning, Planned Unit Development, and Preliminary Plat. This memorandum is attached as <br /> Exhibit B. <br /> NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Centerville, <br /> Minnesota, that it adopts the aforementioned findings of fact related to the requested land use <br /> applications for the Subject Parcels, and DOES ORDAIN the adoption of each recommendation <br /> of the Planning and Zoning Commission approving a Planned Unit Development and <br /> Conditional Use Permit for the Plat "Bay View Villas" to include the variances and conditions <br /> set forth in Exhibit C. <br /> Effective Date. This ordinance shall be effective immediately upon its passage and publication. <br /> 40 <br />
