Stantec <br /> August 24,2018 <br /> Mark Statz <br /> Page 2 of 3 <br /> Reference: Existing Regulations on Electric Scooters and Bikes <br /> It appears that a-bikes and small scooters should be treated as bicycles according to State Statues unless <br /> local rules say otherwise. <br /> Recommendation #1 <br /> Stantec recommends the addition of new ordinance language to the City code specific to low powered <br /> vehicles including electric-assisted bikes and motorized foot scooters. <br /> Additional sections should be made to Chapter 73 of the Code (Regulating Special Vehicles on the <br /> Roadways). Additions should include sections: <br /> • 73.02 Definitions: A definition for`electric assisted bicycle' and a definition for`motorized foot scooter' <br /> should each be added to this section. Applicable language can be found in MN State Statutes <br /> Chapter 169. <br /> • 73.03 Special Vehicle Use On Streets: Specific provisions should be added to this section regarding <br /> the use of electric assisted bicycles and motorized foot scooters. General ideas are listed below, <br /> please let us know if you would like us to write specific language. <br /> o Impounding should be authorized when low power vehicles are parked in such a way that <br /> they obstruct the normal flow of motorized, pedestrian, or any other type of traffic. <br /> o Operations should be dictated for low powered vehicles following rules regarding use of <br /> regular, non-motorized bicycles. State Statutes 169.225 Subd. 1 for scooters and 169.22 <br /> Subd. 4 for a-bikes can be adopted to code. Low powered vehicles are: <br /> ■ Not to be operated on the sidewalk <br /> ■ To follow the same laws as bicyclists and generally be operated on the right-hand <br /> side of the street <br /> ■ To be parked upright using bike racks when possible, and not obstructing the normal <br /> flow of pedestrian, automotive, or any other type of traffic. <br /> o Shared network services should be allowed to operate on public right of way so long as the <br /> service provider has received written permission from City staff. <br /> Recommendation #2 <br /> Stantec recommends the addition of a new chapter under Title VII: Traffic Code. As Chapter 72 is dedicated <br /> to the regulating the use of snowmobiles within city limits, the addition of a new chapter could regulate the use <br /> of low powered vehicles. <br /> Following the same outline as Chapter 72: Snowmobiles, a new chapter would provide a definition for both e- <br /> bikes and foot scooters, state adoption of applicable state laws, and highlight prohibited uses within city limits. <br /> Please let us know if you would like specific language for a new chapter to the code. <br /> \\Us1291-f01\workgroup\1938\active\193803433\Reports\Ebikes_Scooters <br />
