HORSES AND LIVESTOCK ACTIVIES ARE DANGEROUS Minnesota Law recognizes the inherent risks of livestock activities, including horseback riding and equestrian activities. Inherent risks include the propensity of horses and other livestock to kick, bite, buck, or change; their unpredictability when reacting to sound,sudden movement, unfamiliar objects, persons, or other animals, natural hazards and surface or subsurface conditions, and collisions with other livestock or objects. Under Minnesota Statutes§604A.12, a nonprofit sponsor of livest6ock activities is immune from liability for the death of or injury to a participant resulting from the inherent risks of livestock activities. Under Minnesota Statutes§604A.40, an agritourism professional is not liable for injury, damage, or death of a participant resulting from the inherent risks of agritourism activities, including the behavior of wild or domestic animals and the ordinary dangers of structures or equipment ordinarily used in farming or ranching operations. PARTICIPATE AT YOUR OWN RISK PARTICIPANT'S WAIVER OF LIABILITY AND ASSUMPTION OF RISK This acknowledgement and agreement are entered into between Bunker Park Stable ("the Sponsor") and the Participant or his/her parent or guardian who is authorized to execute this agreement on behalf of the Participant. HORSES AND HORSEBACK RIDING ARE DANGEROUS Minnesota law recognizes that inherent risks of livestock activities, including equestrian activities and horses' unpredictability and tendency to buck, kick, bite, react suddenly when frightened,and otherwise act in a manner that could result in death or injury. Minnesota Statutes §604A.12 Under Minnesota Statutes§604A.40, an agritourlsm professional is not liable for injury, damage, or death of a participant resulting from the inherent risks of agritourism activities, including the behavior of wild or domestic animals and the ordinary dangers of structures or equipment ordinarily used in farming or ranching operations. Participant agrees to comply with Sponsor's posted barn and safety rules, including helmet requirement. Participant acknowledges the inherent risks of riding, handling, or merely being present around horses and other livestock. Participant assumes the risk of accident or injury to Participant arising from the inherent danger of equestrian activities and agrees that the Sponsor, its employees,volunteers, and agents are not responsible for accidents. Participant agrees not to sue the Sponsor, its employees,volunteers, or agents, and waives Sponsor's liability for any claim up to and including ordinary negligence,excluding only recklessness,gross negligence, or intentional acts, arising in connection with Participant's activities at or offered by Bunker Park Stable. Participant acknowledges that this Waiver of Liability and Assumption of Risk is intended to protect Sponsor from lawsuits and claims arising from injuries or other damages caused by accidents and the inherent risks of livestock and livestock activities. consent to and authorize the use and reproduction by Bunker Park Stable of any and all photographs and any other audio/visual materials taken of me for promotional material,educational activities, exhibitions of other use. 36
