City of Centerville <br /> Council Meeting Minutes <br /> November 14,2018 <br /> Lateral Fee assessed to their property. He stated that numerous residents took advantage of the <br /> opportunity and now is the time to consider increasing the fee. Administrator Statz stated that <br /> this is the first of two (2)readings and will be brought back to Council at their next meeting. <br /> 3. Alex's Lawn and Turf <br /> a. CUP Update <br /> Administrator Statz stated that the Mayor and Council Member Koski were aware that Alex's <br /> Lawn and Turf submitted an application to amend their existing Conditional Use Permit and <br /> Alex and his attorneys had met with himself and the City Attorney. Administrator Statz had also <br /> met with residents to attempt to secure a working relationship between the residents and the <br /> business owner. Administrator Statz stated that he neglected to extend the 60 day review period <br /> per state statute and Alex's Lawn and Turf's attorney informed the City that they automatically <br /> got their request for additional bins and retail sales. Administrator Statz stated that the City <br /> desires for Alex's Lawn and Turf to prosper as a business within the community but meet all city <br /> requirements, take pride in being a member of the community and work with abutting property <br /> owners to obtain harmony. Administrator Statz stated that he believes that the original CUP <br /> contained language for construction of a wood privacy fence and that language remains. He also <br /> stated that Alex's has neglected to fence the rear portion of his property and he felt that would <br /> assist in eliminating some of the noise neighboring residents were experiencing. Administrator <br /> Statz stated that Alex has stated that he would relinquish his lease with the City for the property <br /> in the rear of the water tower which may assist in the neighborhood noise from the business. He <br /> stated that he did not believe that Alex's desired to continue to utilize the City owned property <br /> around the water tower. <br /> Administrator Statz stated that the situation was unfortunate due to the fact that discussions were <br /> had regarding the installation of a berm and fountains for the abutting neighbors in an attempt to <br /> decrease the noise in the area. Administrator Statz remained hopeful that additional dirt and <br /> trees may defuse noise from machinery utilized by Alex's. Attorney Glaser stated that their <br /> submitted documents for amending the existing CUP were extremely vague. <br /> Previous Mayor Tom Wilharber, 6849 Centerville Road, was in the audience and stated that the <br /> building used to be owned by Eagle Trucking and then the City purchased the property. He <br /> stated that when the City owned the property trucks and traffic were at all hours. He stated that <br /> Alex's Lawn and Turf is a thriving business and believes that an amicable resolution can be <br /> obtained. <br /> Motion by Council Member Love, seconded by Council Member Koski to Table the Items <br /> Until Additional Discussion is had with Alex's Lawn & Turf. <br /> Discussion ensued regarding the existing CUP containing language that states that they will <br /> fence the portion of the property behind the building and install a movable gate to allow access <br /> to the City's facilities. <br /> All in favor.
