City of Centerville <br /> Planning and Zoning Commission <br /> October 2,2018 <br /> Administrator Statz addressed the commission on the progress made in negotiating some <br /> common ground conditions that could be used in a revised CUP, which are presented in the <br /> memo included in the meeting packet. <br /> The commission generally found the conditions outlined in the memo to be an appropriate <br /> balance between business and resident interests. <br /> The Chair then invited the following people to address the commission, regarding the <br /> issue: <br /> Mr. Peter Beck, Beck Law Office, Legal Representative for Alex's Lawn and Turf, <br /> addressed the Commission, stating that they had reviewed the proposed conditions for a <br /> revised CUP and that Alex's could agree to some of the conditions, but felt that many of <br /> them were too restrictive and would hinder Alex's ability to be a successful business. <br /> Mrs. Tammy Bednar, 7068 Cottonwood Court addressed the commission as an informal <br /> representative of the neighborhood as a whole. She said, while she was appreciative of <br /> some of the items listed in the memo, it seemed as though many of the items discussed <br /> with Mr. Statz, at their recent meeting, were left out of the list of proposed conditions. She <br /> did not feel that there were enough concessions made to effectively reduce the noise issues. <br /> Mr. Alex Shuda, Owner/Operator of Alex's Lawn & Turf, stated that he felt the condition <br /> he offered of vacating the lease property to the west of the city's water tower would make <br /> a substantial difference in the noise, since there is a lot of activity in that area and it is the <br /> closest to the neighborhood. Also, he pointed out that they are willing to purchase the <br /> fountains, but would not be able to accept responsibility for their installation or <br /> maintenance. <br /> Considerable discussion was had about whether or not the existing CUP allows two <br /> businesses to operate on the site (Alex's and Yard and Quarry Direct) and whether or not <br /> the existing CUP allows retail sales. <br /> Motion by Commissioner Haiden, seconded by Commissioner Olson to request legal <br /> counsel's opinion on whether the existing Conditional Use Permit allows two <br /> businesses to operate out of the site and/or retail sales. All in favor. Motion carried. <br /> 2. Bay View Villas —Review of Dock Requirements <br /> Administrator Statz explained that representatives from the Bay View Villas development <br /> were asked to appear in front of the commission again to review the proposed requirements <br /> for docks in their development. At the time they last appeared, and gained approval of a <br /> preliminary plat, they had stated there would only be one dock, for day-time tie-up use <br /> available to the upland 9 homes. Since that time, their statements at the city council <br /> meeting and in their marketing materials has tended to stray from those restrictions. <br /> Mr. Jim Boo addressed the commission and asked that they be allowed to have two docks, <br /> with two slips each (total of 4 slips) for the upland nine homes to share. <br /> Page 2 of 4 <br />
