If the Commission entertains the Developer's request for small lap pools or hot tubs, the <br /> Commission may wish to consider how these pools and fencing would sit on the reduced-sized <br /> lots in Bay View Villas. The Commission may wish to consider setting: <br /> Maximum size for small lap pool or hot tubs. <br /> Maximum size of fenced-in areas, or <br /> Restriction against perimeter fencing. <br /> As an example, the Jacuzzi brand company sells a variety of sized tubs. A 6 to 7 person tub is <br /> 91" by 91", and 4 to 5 person tub is 76" by 84". The smallest size motorized lap pool is generally <br /> 84 square feet or 7' by 12'. <br /> a <br /> a <br /> I <br /> YY �y �e ,w•, a a <br /> I ul <br /> RECOMMENDATION: Grant the Developer's request to modify the Conditional Use Permit with <br /> the following revisions and conditions. <br /> • Each lot in Block 1 and Block 2 of Bay View Villas may have no more than one small lap <br /> pool or hot tub. Other accessory structures or water-oriented accessory structures are <br /> prohibited. <br /> • Each pool or tub must be located on a rear patio or deck, and located inside of the <br /> setbacks governing the principal structure on the lot. <br /> • The water area of each pool or tub shall be no larger than 84 square feet. <br /> • The fenced or walled area surrounding each pool or tub shall be no larger than four <br /> times the size of the water area of the pool or tub. <br /> • No lot in Bay View Villas may have a perimeter fence. <br /> • The existing ordinances should govern all other pool and fence requirements, include <br /> the maximum fence height. <br /> • The Homeowners Association may make further restrictions so long as they are <br /> consistent with existing law. <br /> 2 <br />
