d. Any Written Notice or other communication from the City to the <br /> Association shall be sent to the registered address of the Association on <br /> file with the Minnesota Secretary of State or to such other address as the <br /> Declarant or the Association may provide to the City, in writing, from <br /> time to time. Any Written Notice or other communication from the City <br /> to the Declarant shall be sent to such address and in a manner as set forth <br /> in the Development Agreement between the City and the Declarant. <br /> 19.03 Planned Unit Development And Conditional Use Permit. The Association <br /> recognizes that the Property and the Plat are subject to a Planned Unit <br /> Development And Conditional Use Permit (the "Permit"), issued by the City, and <br /> recorded against the Plat. The Association, the Owners, and the Declarant (if <br /> applicable), joint and severally, are bound by the Permit. The Association is <br /> required to enforce the conditions set forth in the Permit. In particular, the <br /> Association must maintain and preserve the following elements identified in the <br /> Permit: <br /> a. The shoreline of Centerville Lake; <br /> b. The"Landscape Plan" as set forth in the Permit; and, <br /> c. Stormwater ponds and facilities on all commonly-owned and private property <br /> to include but not limited to vegetation management in and around ponds and <br /> storm sewer structures (inlet and outlet), trash removal, and other general <br /> maintenance. <br /> 19.04 City Approval Required. The following provisions shall require the written <br /> consent of the City: <br /> a. Amendments affecting the City's rights and interests in the Association; <br /> b. Declarant exercising the rights set forth in Section 15; <br /> c. Amendment to the maintenance responsibilities of the Association as <br /> described in Sections 9.1 <br /> SECTION 20 <br /> PROPERTY DISCLOSURE <br /> 20.1 Declarant hereby discloses that Declarant does not intend to build the Dwellings <br /> to be located within the Property, and Declarant makes no representation or <br /> warranty concerning the identity of any Homebuilder who may be constructing <br /> Dwellings or other Improvements on the Property. <br /> (Signature Page Follows) <br /> 37 <br /> Version for Council 05/22/2019 <br />
