the level of effort needed to perform dewatering and storm flow routing operations. All <br /> dewatering shall be in accordance with all applicable county, state, and federal rules and <br /> regulations. Department of Natural Resources regulations regarding appropriations permits shall <br /> also be strictly enforced. <br /> 14. CLEAN UP. The Developer shall daily clean dirt and debris from streets that has <br /> resulted from construction work by the Developer, its contractors, subcontractors, agents or <br /> assigns. Prior to any construction on the Land, the Developer shall identify in writing a <br /> responsible party for erosion control, street cleaning, and street sweeping. During such times as <br /> construction is active, developer or his agent shall frequently inspect streets and make sure that <br /> they are swept of dirt and debris. <br /> 15. SITE PROVISIONS. <br /> A. Developer shall be responsible for Security at the site during construction. <br /> B. Developer shall maintain communication with the neighboring properties and <br /> address any concerns raised by the neighbors in a timely manner <br /> C. Developer shall repair damage to the neighboring streets, curbs, trails, or other <br /> public infrastructure caused by construction of the Project, at their own expense. <br /> D. Developer shall provide traffic control for any work within the right-of-way. <br /> 16. OWNERSHIP OF IMPROVEMENTS. Upon completion and acceptance of the <br /> work and construction required by this Agreement, the Public Improvements lying within public <br /> right-of-way and easements shall become City Property without further notice or action. Those <br /> improvements shall include but are not limited to the sanitary sewer,potable water system, storm <br /> sewer, roads, sidewalks, trails, draintile, signage and street lighting (unless owned by the utility). <br /> The extent of sewer and water service lines ownership is further defined in city code. The <br /> Developer shall retain ownership and maintain all ponds and other erosion control measures, and <br /> the Plat shall indicate an easement in favor of the Public for storm water use, access and <br /> maintenance. However, the Developer shall maintain ponds and other erosion control measures <br /> until the development is complete in conformance with this Agreement, and provided that the <br /> VERSION FOR COUNCIL 05/22/2019 Page 9 <br />
