slip. Each of these docks is exclusively for the use and enjoyment of <br /> residents living at each respective parcel. Watercraft regularly moored in <br /> those slips must be registered at the address where the dock is located. <br /> b. Block 2 docks. The Home Owners Association may construct and <br /> maintain no more than two docks on Outlot B. Each dock may have no <br /> more than two slips for docking a single watercraft in each slip. These <br /> docks are exclusively for the use and enjoyment of residents living in <br /> Block 2. Watercraft regularly moored in those slips must be registered to <br /> an address in Block 2. <br /> c. All docks and slips shall be constructed according law and the regulations <br /> of the Minnesota Department of Natural Resources. <br /> 15. Shoreline Preservation. The shoreline will be preserved by designating a swath of <br /> land defined by a drainage and utility easement as shown on the Plat with a <br /> minimum width of 30-feet the Ordinary High Water Level of Centerville Lake <br /> across the lakeside of Lots 1 — 9, Block 1 and Outlot B of the Plat. This area is <br /> covered by a drainage and utility easement on the Plat and this easement shall be <br /> construed to allow access to the City for the purposes of inspecting and <br /> enforcement of maintenance of the area in accordance with the approved <br /> Landscape Plan. The landscaping and construction of this area must follow said <br /> Plan and the area must be maintained in perpetuity by the Home Owners <br /> Association in such a way as to preserve the initial intent of said Plan. Grass <br /> clippings must be bagged or blown in the opposite direction of the lake and no <br /> fertilizer may be used after initial turf establishment. <br /> 16. The Landscape Plan, attached as Exhibit A. The Landscape Plan governs all <br /> parcels subject to this Permit. That Plan shall be perpetually implemented and <br /> maintained. The Home Owners Association shall maintain all commonly-owned <br /> properties in a manner conforming to the Landscape Plan. The Home Owners <br /> Association shall enforce the maintenance of the Landscape Plan on private <br /> property under the control and governance of the Association. Any alteration to <br /> the Landscape Plan shall be signed by a Landscape Architect registered in the <br /> State of Minnesota, subsequently approved by the City, and thereafter must be <br /> recorded as an addendum to this Conditional Use Permit. <br /> 17. Stormwater Management. The Home Owners Association shall maintain all <br /> stormwater ponds and facilities on all commonly-owned property. The Home <br /> Owners Association shall enforce the maintenance of stormwater ponds and <br /> facilities on private property under the control and governance of the Association. <br /> 18. The Subject Parcel shall meet and abide by the applicable standards, <br /> requirements, permits or licenses of the City of Centerville, Rice Creek <br /> Watershed District, Anoka County, Army Corp of Engineers, Federal Emergency <br /> Management Agency, Minnesota Pollution Control Agency, Minnesota <br /> Department of Health, Environmental Protection Agency, or their antecedent <br /> agency, and any other agency having jurisdiction over the property and business <br /> activities that are taking place on said property. <br /> 19. The City may annually review this permit for of review of measures imposed to <br /> manage stormwater or shoreline preservation, or for other unforeseen conditions <br /> on the Subject Parcel.
