which approval may be withheld in the Board's sole discretion, (ii) obtaining <br /> prior written approval from the City, (iii) compliance with all Association Rules <br /> and Regulations governing such structures, (iv) compliance with all City codes <br /> and ordinances governing such pools and hot tubs, and, (v) compliance with the <br /> Conditional Use Permit governing the Bayview Villas Plat, only allowing pools <br /> on a parcel larger than 20,000 square feet. <br /> 7.16 Rights of Declarant and Homebuilders. Until the last Unit is sold and <br /> conveyed to an Owner other than the Declarant or a Homebuilder, the following <br /> action by the Declarant or a Homebuilder, and their agents and assigns, will not <br /> be deemed violations of the foregoing restrictions: <br /> a. Use of a Dwelling for model and sales office purposes; <br /> b. Storage of equipment, materials or earth during the construction of new <br /> Dwellings on Units and used in conjunction with such construction <br /> purposes; and <br /> C. Display of signs advertising Units in the Property, subject to City and state <br /> ordinances and codes. <br /> SECTION 8 <br /> ARCHITECTURAL CONTROL <br /> 8.1 Restrictions on Alterations. The following restrictions and requirements shall <br /> apply to alterations on the Property: <br /> a. Except as expressly provided in this Declaration, no structure, building, <br /> addition, deck, patio, pool, hot tub, fence, wall, enclosure, window, <br /> exterior door, sign, display, decoration, color change, shrubbery, material <br /> topographical or landscaping change, nor any other exterior Improvements <br /> to or alteration thereof, or alteration of any Dwelling or any other part of a <br /> Unit which is visible from the exterior of the Unit (collectively referred to <br /> as "alterations"), shall be commenced, erected or maintained in a Unit, <br /> unless and until the plans and specifications showing the nature, kind, <br /> shape, height, color, materials and locations of the alterations shall have <br /> been approved in writing by the Architectural Control Committee, <br /> described below. <br /> b. The Architectural Control Committee (the "ACC") shall consist of three <br /> (3) members. The Declarant shall have the exclusive authority to appoint <br /> and remove the members of the ACC for a period of time extending until <br /> Declarant voluntarily surrenders such control. Specifically, Declarant's <br /> right to control the ACC may extend beyond Declarant's Control Period <br /> over the Association, as described in Section 4.5, above.
