B. The Final Plat must meet the requirements and approval of the City Engineer; <br />C. The Final Plat must meet the requirements and approval of the County Surveyor; and, <br />D. The Final Plat must be recorded in a manner where it is not subordinate to any <br />easement, lien, mortgage, encumbrance, or other interest. <br />E. The Final Plat must be recorded simultaneously to the Conditional Use Permit <br />governing the BAY VIEW VILLAS where the priority of the Conditional Use Permit <br />immediately follows the Plat. <br />F. The Final Plat and Conditional Use Permit must be recorded simultaneously to the <br />Declaration of the Bayview Villas Home Owners Association. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Centerville, <br />Minnesota, does Ordain, and <br />1. APPROVES the Declaration of Covenants, Conditions, and Restrictions For Bayview <br />Villas. <br />2. APPROVES recording the Final Plat for the BAY VIEW VILLAS subject to the <br />following conditions: <br />a. Approval for recording of the Final Plat is contingent upon execution of, and <br />subject to the terms of the Subdivision and Development Agreement, First <br />Amendment, with the City for the Platted land; <br />b. Approval for recording of the Final Plat is contingent on recording the Plat in a <br />manner where it is not subordinate to any easement, lien, mortgage, encumbrance, <br />or other interest; and, <br />c. Approval for recording of the Final Plat is contingent upon simultaneous <br />recordation to the Conditional Use Permit governing the BAY VIEW VILLAS <br />where the priority of the Conditional Use Permit immediately follows the <br />recording prior of the Plat. <br />d. The Final Plat and Conditional Use Permit is contingent upon simultaneous <br />recordation to the Declaration of Covenants, Conditions, and Restrictions For <br />Bayview Villas. <br />3. AUTHORIZATION FOR RECORDING the Final Plat with Anoka County is subject to <br />the following conditions: <br />a. The Final Plat must meet the requirements and approval of the City Engineer; <br />and, <br />b. The Final Plat must meet the requirements and approval of the County Surveyor. <br />4. The City Administrator shall determine when the conditions governing the Authorization <br />for Recording have been satisfied. Once the conditions have been satisfied he shall author <br />a letter certifying satisfaction of these conditions. <br />5. The Applicant is authorized to File and Record the Final Plat for BAY VIEW VILLAS <br />with Anoka County after receiving written certification from the City Administrator. <br />Page 2 of 3 <br />
