City of Centerville <br />Council Meeting Minutes <br />October 23, 2019 <br /> <br />2. Water Tower Driveway Construction <br /> <br />Administrator Statz stated that staff has forwarded correspondence and cancelled the current lease <br />with Alex’s Lawn and Turf for use of the watertower property. He stated within the same letter <br />Alex’s was requested to construct a fence that the Conditional Use Permit requires around the <br />watertower. Administrator Statz stated that on occasion there has been difficulty gaining access <br />to the watertower due to Alex’s equipment placement or keys not in the lockbox. He stated that <br />the City has a 30’ easement along the southern side of the parcel and a 16’ driveway would allow <br />staff 24/7 access to the tower. He stated that a gate would also need to be constructed by Alex’s <br />to allow this. <br /> <br />Council Member Love questioned if a roadway was placed there, would there be a need for a gate. <br />Administrator Statz stated that Alex’s owns the property and the City has an easement on/over the <br />property. He also stated that they cannot block or store items within that easement. Council <br />Member Love questioned the construction timetable. Administrator Statz stated that Alex’s was <br />given until the end of November and that gravel could be placed this fall with paving in the spring. <br /> <br />Discussion ensued regarding Alex’s use of the driveway and Attorney Glaser stated that the <br />property is owned by Alex’s Lawn and Turf. Administrator Statz stated that they cannot block the <br />area. There was concern for the weight equipment that Alex’s utilizes and same being on the <br />driveway. There was also concern for maintaining the driveway. It was stated that the City already <br />has access to the watertower. Discussion ensued regarding Alex’s construction of a fence and a <br />gate at their expense and that the City could ask for an additional gate that rolls. Council Member <br />Montain questioned the cost of paving and Administrator Statz anticipated $6-12,000 for paving, <br />plowing and maintenance. There was concern for discussion with Alex’s Lawn and Turf and their <br />desires for the property. <br /> <br />Mayor Paar questioned the frequency of accessing the watertower site and Administrator <br />Statz stated once per day. Mayor Paar stated that the desire of Council is that the site remains <br />clean, ease of entrance/exit to City infrastructure and the harmonious location of the business and <br />residents. He stated that he desired to learn Alex’s comments regarding entrance and exit to the <br />site and which would be less disruptive to his operation prior to making a decision. He also stated <br />that he is uncomfortable with the ongoing maintenance expenditure associated with the driveway. <br /> <br />Staff was directed to discuss the least disruptive route for Staff to gain access to and from the <br />watertower from Alex’s Lawn and Turf and bring that information back to Council for <br />consideration. <br /> <br />Motion by Council Member Love, seconded by Council Member Montain to Table this Item. <br />All in favor.
