MEMORANDUM <br />TO: City Council <br />FROM: Kurt Glaser, City Attorney <br />DATE: January 22, 2020 <br />RE: Atlas Villas Memory Care <br />1825 Main Street <br />Recommendation to approve Interim Use Permit <br />EXECUTIVE SUMMARY <br />The City Attorney recommends issuing an Interim Use Permit to Gonion Group, LLC, <br />allowing them to build and operate their senior living/memory care facility. The interim <br />use will afford them time to 1) obtain licensure for the facility and 2) address the public <br />safety concerns set forth below. This interim use is intended as a path toward granting a <br />Conditional Use Permit once the applicant has satisfied those concerns. The Interim Use <br />Permit and the future Conditional Use Permit would be granted on the terms <br />recommended by the City Planners in their companion memorandum. <br />BACKGROUND <br />Gonion Group LLC has applied for a Conditional Use Permit to build a 16-unit senior <br />living/memory care facility on a vacant site located at 1825 Main Street. The site is <br />zoned B-2 Main Street Commercial district. "Specialized care facilities" are allowed as a <br />conditional use in the B-2 zoning district. City code defines a "Specialized Care Facility" <br />as A state -licensed care facility which is not otherwise specifically defined or regulated <br />elsewhere in this chapter. <br />The City Planners, Lauren Walburg, Stantec, Urban Planner, and Phil Carlson, AICP, <br />Stantec, Senior Planner, have submitted a memorandum addressing zoning and site <br />plan considerations for this application. A version of this memorandum now submitted <br />by the City Attorney addressed the public safety considerations related to this <br />application to the Planning and Zoning Commission. <br />The Planning and Zoning Commission adopted the information provided by Stantec <br />and the City Attorney; and recommends adopting their Findings of Fact and <br />recommend approving an Interim Use Permit allowing Gonion Group, LLC, allowing <br />them to build and operate their senior living/memory care facility. <br />DISCUSSION <br />Facility Licensure <br />The requires licensure from the State of Minnesota and Anoka County to operate their <br />proposed senior living and memory care facilities.
