On April 28, 2004, the City sent a letter to Kim Moore-Sykes expressing <br />our concerns regarding the inadequacy of the existing gravel road for the specified use. <br />We requested that consideration be given to improving the roadway as part of the <br />development. <br /> <br />It has become apparent that no such improvements are currently being contemplated. <br />The City has only received assurances from the cement plant owner, Dennis Shudy that <br />he would gravel and water down the roadway as needed. This is not acceptable. We <br />respectfully request that the City of Centerville provide us with your plans to maintain <br />and/or improve this section of roadway. We recommend, at a minimum, that the <br />roadway be paved to accommodate the increased truck traffic. As an alternative, access <br />to Cedar Street from the site could be eliminated and redirected to existing roadways <br />internal to Centerville's industrial park. <br /> <br />The City of Lino Lakes is currently providing temporary municipal water to the cement <br />plant. Please be advised that we will tenninate such service within seven (7) days from <br />the date of this letter if there is no resolution to this issue. We will also be considering <br />modification and/or termination of existing street maintenance agreements between the <br />two cities unless this issue is satisfactorily resolved. <br /> <br />Additionally, it was recently brought to our attention that sanitary sewer and water main <br />are proposed to be constructed along Cedar Street from CR 54 to the construction site. <br />Please be advised that our records show that Cedar Street does 110t lie On publicly <br />dedicated right-of-way. It exists as a prescriptive right for street purposes.
