CITY OF CENTERVILLEREQUEST FOR ACTION Agenda Item # Department: RequestedMeetingDate: March 10, 2020 Planning VI.2 TITLE OF ISSUE: On/Off Street Parking BACKGROUND AND SUPPLEMENTAL INFORMATION: At the last Planning and Zoning Commission meeting, the issue of on/off street parking was reviewed, especially as it relates to certain situations in the downtown area, as we prepare for the reconstruction of the streets in that area. Attached are some sketch layouts of various parking arrangements for a business in downtown. Our attorney has given an opinion related to the status of a business or homeowner's parking arrangement as a legal non-conformity. In summary, he asserts that parking facilities on private property may be somewhat protected by the legal non-conformity status, but parking facilities that extend into the city's right-of-way would not be afforded those same protections, nor would the location or size of an access to the road. The city has the right and duty to control its right-of-way and access to it for the health, safety, and wellfare of the public. COST AND SOURCE(S) OF FUNDING: N/A REQUESTED ACTION: Direct staff on whether or not certain changes or clarifications to the existing city code should be explored related to on/off street parking.
