CITY OF CENTERVILLEREQUEST FOR ACTION Agenda Item # Department: RequestedMeetingDate: March 10, 2020 Planning/Code Enforcement VI.2 TITLE OF ISSUE: Witzel Electric - Nuisance Violation Appeal BACKGROUND AND SUPPLEMENTAL INFORMATION: In August 2019, the P&Z Commission heard an appeal of the Zoning Administrator's (ZA) decision on a nuisance violation related to lighting at Witzel Electic. A letter from the ZA to Witzel Electric and the response letter are attached. Also attached are the minutes from the August meeting where the appeal was heard. The appeal was "...tabled pending action by Mr. Witzel to abate the nuisance." Mr. Witzel installed a small extension to the hood on one of the lights. However, the complainant did not see a difference in the glare. Mr. Witzel was made aware that this hood extension had not solved the problem. No further action has been taken by Mr. Witzel since then. A few months ago, Mr. Witzel left a voicemail message for the ZA stating that there had been an auto theft from the parking lot. He is also asserting that the responding officer was in support of his lighting to deter crime. Attached is the written opinion of another officer who examined the area at night.
