CITY OF CENTERVILLE REQUEST FOR COUNCIL ACTION Agenda Item # Department: Requested Council Meeting Date: March 11, 2019 Engineering/Public Works VII.5 TITLE OF ISSUE: Utility Easement - CenterPoint Energy BACKGROUND AND SUPPLEMENTAL INFORMATION: Several years ago, the city abandoned the Goiffon Road right-of-way from Sorel Street to Main Street. Often when streets are abandoned, the city will retain rights to utility and/or drainage easements. However, in this case, we did not immediately find evidence of this. CenterPoint Energy has a gas line in this former right-of-way and is looking to replace it. It is likely that they could pursue legal action to reclaim an easement for their facility. However, in working with them, we suggested the use of our trail corridor a half block to the east. The city owns a narrow piece of property there, where we have a water main and trail. The attached are documents which would have the city grant an easement to CenterPoint to install and maintain a gas main on our property. Staff feels that this is a good way to cooperate with our local utilities and property owners, with little to no risk to the city. COST AND SOURCE(S) OF FUNDING: Income of $1 for easement granting REQUESTED COUNCIL ACTION: Motion to approve the easement documents with CenterPoint Energy.
