is effective <br />May 22, 2019, by and between the CITY OF CENTERVILLE, a Minnesota municipal <br />ELMCREST VISTAS, a Minnesota Limited Liability Corporation, <br />SUPPLIMENTAL AGREEMENT AND CODICIL <br /> is effective ___________ ##, 2020, as a supplement and codicil to the original <br />Agreement. <br /> The Agreement is controlling and governs the terms and conditions between the parties <br />except where specifically set forth in this Supplement. The Plat for Old Mill Estates was the first <br />phase of development as contemplated by the Agreement, and Old Mill Estates Second Addition <br />is the second phase of development as contemplated by the Agreement. This Supplement is <br />intended to amend and revise aspects of the Agreement which relate to the development of Old <br />Mill Estates Second Addition. If the terms and conditions contained in the Agreement and <br />Supplement are in conflict, the contents of the Agreement shall take precedence over the <br />contents of this Supplement. <br /> 1. REQUEST FOR PLAT AND DEVELOPMENT APPROVAL. The Developer <br />has asked the City to approve a final plat for Outlot A of the plat for Old Mill Estates. <br />Hereinafter, this plat revision shall be referred to as a request for final plat approval for Old Mill <br />Estates Second Addition (referr <br />of Anoka, State of Minnesota, and is legally <br />described on the attached Exhibit A, including easements described therein.
