Developer with a written notice of work that is unacceptable and what is required to make the work <br />acceptable to the City. Upon completion of corrections to the unacceptable work, the developer <br />shall, again, notify the City in writing and request acceptance of the work. The timeline above, <br />then resets. If the City fails to provide a written notice of unacceptable work within 30 days, then <br />written request for acceptance. <br /> C. The Developer warrants all Improvements required to be constructed by it pursuant <br />to the Agreement and this Supplement against poor material and faulty workmanship. The <br />warranty period for underground utilities is two years from the date of acceptance by the City. If <br />all Improvements are installed by one contractor, the warranty period shall commence after the <br />final wear course has been completed and the City has accepted the streets, unless installation of <br />the wear course has been delayed by the City, in which case the two-year period shall commence <br />on the later of September 30, 2021, or the requested extension date requested by Developer <br />pursuant to Section 9 herein. If streets and underground utilities are installed by separate <br />contractors, the two (2) year warranty period on underground utilities shall commence following <br />their completion and acceptance by the City. The Developer or his contractor shall post security <br />in the amount of thirty-five percent (35%) of final construction costs to secure the warranties. The <br />Developer or his contractor may use the existing Letter of Credit or a maintenance bond to satisfy <br />this condition. The City standard specifications for utilities and street construction identify the <br />procedures for final acceptance of streets and utilities. <br /> In the event of default by the Developer as to any <br />of the work to be performed by it hereunder, the City may, at its option, perform the work and the <br />Developer shall promptly reimburse the City for any expense incurred by the City, provided the <br />Version 8/6/2020-1 for Council packet Page 11 <br /> <br />
